This being said, we believe that the sweeping language of the proposed article II, paragraph 2 of the New York Convention needs to be qualified to indicate that the arbitration agreement must be proved to have been properly concluded.

III. Interpretative instrument regarding article II(2) of the New York Convention

The court of first instance had not found any grounds to refuse the recognition and enforcement of a foreign arbitral award, under the terms of article V, paragraph 2, of the New York Convention.

The Court ruled that the suitable security referred to in article VI of the New York Convention could be provided by the institution of Russian interim measures adopted by the Court on the application of the party in whose favour the arbitral award had been invoked.
