The Committee recommends that the State party take steps to allow the National Commission on Security Ethics to accept complaints directly from anyone claiming to have been subjected to torture or cruel, inhuman or degrading treatment in any territory under its jurisdiction, in accordance with article 13 of the Convention.

Article 12 of the Convention against Torture expressly obligates States parties to investigate all allegations of torture, asserting that each State party should ensure that its competent authorities proceed to a prompt and impartial investigation wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.
49- وتلزم المادة 12 من اتفاقية مناهضة التعذيب صراحة الدول الأطراف بالتحقيق في جميع ادعاءات التعذيب، وتؤكد أن على كل دولة طرف أن تضمن قيام سلطاتها المختصة بتحقيق فوري ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها القضائية.

According to article 12, States parties shall undertake prompt, effective and impartial investigations, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction as the result of its actions or omissions and, as set out in article 13 and affirmed by the Committee in its general comment No. 2, ensure that impartial and effective complaints mechanisms are established.

The Working Group further recalls that, pursuant to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, to which Bahrain is also a party, the Government " shall ensure that its competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction " (article 12).
29- ويذكّر الفريق العامل كذلك بأن اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة القاسية أو اللاإنسانية أو المهينة، التي انضمت إليها البحرين أيضاً، تنص على أن تكفل الحكومة " قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما وجدت أسباب معقولة تدعو إلى الاعتقاد بأن عملاً من أعمال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها القضائية " (المادة 12).

Article 12 of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment also expressly obliges States parties to investigate all allegations of torture, in stipulating that they ensure that their competent authorities proceed to a prompt and impartial investigation, wherever there is reasonable ground to believe that an act of torture has been committed in any territory under its jurisdiction.
كما أن المادة 12 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة تلزم صراحة الدول الأطراف بالتحقيق في جميع ادعاءات التعذيب، فهي تنص على أن " تضمن هذه الدول الأطراف قيام سلطاتها المختصة بإجراء تحقيق سريع ونزيه كلما وُجدت أسباب معقولة تدعو إلى الاعتقاد بأن فعلاً من أفعال التعذيب قد ارتكب في أي من الأقاليم الخاضعة لولايتها().

In this context, the Human Rights Committee has authoritatively interpreted article 7 of the International Covenant on Civil and Political Rights and found that it is not sufficient for the implementation of article 7 to prohibit such treatment or punishment, or to make it a crime: States should inform the Committee of the measures they take to prevent and punish acts of torture or other ill-treatment in any territory under their jurisdiction.
وفي هذا السياق، فسرت اللجنة المعنية بحقوق الإنسان بحجية المادة 7 من العهد الدولي الخاص بالحقوق المدنية والسياسية وخلصت إلى أنه لا يكفي لتنفيذ المادة 7 حظر أو تجريم هذه المعاملة أو العقوبة، بل يجب أن تخبر الدول اللجنة بالتدابير المتخذة لمنع ومعاقبة أفعال التعذيب أو سوء المعاملة في أي إقليم من الأقاليم الخاضعة لولايتها القضائية().

In the context of the Third International Decade for the Eradication of Colonialism, it called on the administering Powers to fulfil their commitments to the Non-Self-Governing Territories, taking into account the specific situation in each case, to cooperate fully with the Special Committee, and to regularly communicate accurate information on each of the Territories under their administration.
وفي سياق العقد الدولي الثالث للقضاء على الاستعمار، تدعو الجماعة الدول القائمة بالإدارة إلى الوفاء بالتزاماتها تجاه الأقاليم غير المتمتعة بالحكم الذاتي، مع مراعاة الأوضاع المحددة في كل حالة من الحالات، والتعاون تعاونا كاملا مع اللجنة الخاصة، والقيام بشكل منتظم بإبلاغ المعلومات الدقيقة عن كل إقليم من الأقاليم الخاضعة لإدارتها.

18. CELAC renewed its call to the administering Powers to adopt the necessary measures to bring rapidly to fruition the decolonization of each of the Non-Self-Governing Territories, including those that were the subject of sovereignty disputes, and also to communicate regular and accurate information on each of the Territories under their administration, pursuant to Article 73 e of the Charter.
18 - وأضاف أن جماعة دول أمريكا اللاتينية ومنطقة البحر الكاريبي تكرر نداءها إلى الدول القائمة بالإدارة لاتخاذ التدابير اللازمة للتحقيق السريع لإنهاء استعمار كل من الأقاليم غير المتمتعة بالحكم الذاتي، بما فيها تلك التي هي موضوع نزاعات على السيادة، وكذلك إحالة معلومات منتظمة ودقيقة عن كل من الأقاليم الخاضعة لإدارتها، عملا بالمادة 73 (هـ) من الميثاق.
