The notion of an international crime, as defined in article 19 of Part One of the draft articles on State responsibility, should be reviewed by the Commission in the light of recent developments in the theory and practice of international law.
وأضافت أن مفهوم الجنايات الدولية، على النحو المحدد في المادة ١٩ من الباب اﻷول من مشاريع المواد التي تتناول مسؤولية الدول، لابد من إعادة النظر فيه من جانب اللجنة في ضوء التطور اﻷخير لنظرية القانون الدولي وتطبيقاته.

Although the Commission had devoted a great deal of attention to the question of the consequences of acts characterized as crimes under article 19 of Part One of the draft articles, the problem was far from resolved.
٣ - وقال إنه رغم أن اللجنة قد وجهت قدرا كبيرا من الاهتمام الى مسألة نتائج اﻷفعال التي وصفت بأنها جنايات بمقتضى المادة ١٩ من الباب اﻷول من مشروع المواد، فإن المشكلة لم تحل.

At its last session, the Commission had had a rich and stimulating debate on the question of the consequences of acts which were characterized as crimes under article 19 of Part One of the draft.
١٦ - وأردف قائلا إن اللجنة قامت، في دورتها السابقة، بإجراء مناقشات قوية ومشجعة بشأن مسألة نتائج اﻷفعال التي وصفت بأنها جنايات بمقتضى المادة ١٩ من الباب اﻷول من مشروع المواد.

13. On the issue of attribution, consistency and symmetry of language in the provisions of chapter II of Part One of the draft articles were important.

Turning to the matter of State responsibility, and specifically the question of the consequences of acts characterized as crimes under article 19 of Part One of the draft articles, his delegation maintained its view that the distinction between international crimes and delicts should be retained.

He referred in that regard to the concept of State crime in article 19 of Part One of the draft articles on State responsibility as well as to the draft articles on international liability for injurious consequences arising out of acts not prohibited by international law.

The link between article 19 of Part One of the draft articles on State responsibility should also be taken into account, since the actions of individuals contributed significantly to the perpetration of crimes by States.

5. With regard to State responsibility, the procedure proposed in article 19 of Part One of the draft, by involving the General Assembly, the Security Council and the International Court of Justice, caused problems that needed to be satisfactorily addressed.

To improve the legal order further, Act No. 26788 of 16 May 1997 was enacted to amend Chapter III of Title I of the Penal Code by incorporating, as an aggravating circumstance, the existence of a family relationship between the aggressor and the victim, in terms of the penalties applicable to crimes involving serious or light injuries or offences against the person.
21 - ورغبة في إحكام النظام القانوني، تم بموجب القانون رقم 26788 الصادر في 16 أيار/ مايو 1997، تعديل الفصل الثالث من الباب الأول من قانون العقوبات بإدراج وجود قرابة عائلية بين المُعتدي والضحية كظرف مُشدِّد للعقوبات المطبقة على جرائم الإصابة بضرر بالغ أو خفيف والخطأ في حق الشخص.
