According to that draft article, an international organization incurs international responsibility when it circumvents one of its international obligations by adopting a decision binding a member State or international organization to commit an act that would be internationally wrongful if committed by the former organization.

In its Judgment in the Gabcíkovo-Nagymaros Project case, the International Court of Justice also stressed the requirement that there be a threat to an " `essential interest'of the State which is the author of the act conflicting with one of its international obligations " .

1- تقع المسؤولية الدولية على الدولة العضو في منظمة دولية إذا سعت هذه الدولة إلى تفادي الامتثال لالتزام من التزاماتها الدولية عن طريق الاستفادة من وجود صلاحية لدى المنظمة الدولية فيما يتصل بموضوع ذلك الالتزام، فتدفع المنظمة بذلك إلى ارتكاب فعل لو ارتكبته تلك الدولة لشكل خرقاً لذلك الالتزام.

In principle, a State does not have the right to claim exemption from its international obligations by reason of an ongoing internal armed conflict, unless that internal armed conflict has deprived that State of the ability to fulfil its treaty obligations.
