53. Under article 115 of the Constitution in force at the time of the visit, the High Court of the Maldives had jurisdiction to hear all appeals from the Courts of the Maldives and hear other cases as determined by the President of the Republic.

245. Article 5, paragraph 3, of the current Constitution provides that Cape Verdeans may acquire the nationality of another country without losing their original nationality.

432. In the Republic of Cape Verde, all human beings are considered equal before the law (art. 23 of the current Constitution).

- The right to freedom of thought, expression, information, association, religion, worship, intellectual, artistic and cultural creation and demonstration, and others (art. 28 of the current Constitution);
- الحق في حرية الفكر والتعبير والإعلام والترابط والدين والعقيدة والإبداع الفكري والفني والثقافي والتظاهر، وما إلى ذلك (المادة 28 من الدستور الساري)؛

- The right to freedom and personal security in that any person who is unlawfully arrested or detained may bring a habeas corpus case before the competent court (arts. 29 and 35 of the current Constitution);
- الحق في الحرية والأمن الشخصي، مع تمكين كل من يتعرض للاحتجاز أو الاعتقال على نحو غير مشروع من الحضور أمام المحكمة المختصة (المادتان 29 و35 من الدستور الساري)؛

251. Aliens or stateless persons who are legal residents or who are seeking asylum may be legally expelled only as provided for under the law (art. 36 of the current Constitution).
251 - ولا يجوز طرد الأجنبي أو عديم الجنسية الذي سبق أن سُمِح له بالسكنى داخل البلد أو طالب اللجوء إلا بموجب حكم قضائي ومن منطلق تطبيق القانون (المادة 36 من الدستور الساري).

31. With regard to the protection of the natural balance in which indigenous peoples live and work, article 342 of the new Constitution provides that " the State and the population shall be bound to conserve, protect and sustainably use natural resources and biodiversity and to maintain the balance of the natural environment " .
31 - فيما يتعلق بحماية التوازن الطبيعي الذي تعيش فيه الشعوب الأصلية، تنص المادة 342 من الدستور الساري على أن " من واجب الدولة والشعب الحفاظ على الموارد الطبيعية والتنوع البيولوجي وحمايتها واستخدامها بشكل مستدام، وكذلك الحفاظ على التوازن في البيئة " .

Article 191, paragraph I, of the new Constitution recognizes indigenous jurisdiction: " Indigenous and aboriginal farming nations and peoples shall exercise jurisdictional functions and powers through their authorities and shall apply their own principles, cultural values, rules and procedures " .
وتقر الفقرة الأولى من المادة 191 من الدستور الساري بولاية الشعوب الأصلية: " تمارس الأمم والشعوب الأصلية والزراعية مهامها وصلاحياتها بحكم ولايتها من خلال سلطاتها وتطبق مبادءها وقيمها الثقافية والقواعد والإجراءات الخاصة بها " .

9.2 The Committee notes the authors' claim that the automatic deletion of their names from the electoral registers, by application of article 70, paragraph 5, of the Constitution in force at the time of submission of their communication, breached article 29, read alone and in conjunction with article 12 of the Convention.
9-2 وتحيط اللجنة علماً بادعاء أصحاب البلاغ بأن شطب أسمائهم تلقائياً من سجلات الناخبين بمقتضى أحكام الفقرة 5 من المادة 70 من الدستور الساري وقت تقديم البلاغ كان فيه انتهاك للمادة 29 مقروءة وحدها وبالاقتران مع المادة 12 من الاتفاقية.
