The delegation of Singapore proposed the formulation of article 13, paragraph 1, of the Model Treaty on Mutual Assistance in Criminal Matters, which reads as follows:
واقترح وفد سنغافورة صيغة الفقرة ١ من المادة ٣١ من المعاهدة النموذجية لتبادل المساعدة في المسائل الجنائية ، التي نصها كما يلي :

One country could receive extradition requests in urgent cases via INTERPOL; the same country also applied the simplified proceedings in article 6 of the Model Treaty on Extradition.
وقد طبقت تلك الدولة أيضاً إجراءات التسليم المبسطة الواردة في المادة 6 من المعاهدة النموذجية لتسليم المجرمين.

This is the approach recommended in article 2 of the Model Treaty on Extradition adopted by the General Assembly in its resolution 45/116 of 14 December 1990.

20. It was noted that the grounds for postponement specified in article 4, paragraph 3, of the Model Treaty were broader than the grounds for refusal set forth in article 4, paragraph 1 (d), which dealt with concerns about double jeopardy.

The Republic of Korea further mentioned that article 3 of the Model Treaty seemed to concretize penalties and administrative sanctions under article 8 of the 1970 UNESCO Convention, and left the types of sanctions to be adopted to the discretion of each State party; however, it intends to secure the effectiveness of sanctions by specifying the actors to be subjected to the sanctions.
7- كما أفادت جمهورية كوريا أيضا بأنَّ المادة 3 من المعاهدة النموذجية تجسّد على ما يبدو العقوبات والجزاءات الإدارية الواردة في المادة 8 من اتفاقية اليونسكو لعام 1970، وتترك نوعية الجزاءات المعتمدة لتقدير كل دولة طرف؛ لكن الغرض منها ضمان فاعلية الجزاءات عن طريق تحديد الجهات التي تخضع للجزاءات.

It would also be advisable to adopt a specific guideline concerning the grounds for refusal as set out under article 3 (Mandatory grounds for refusal) of the Model Treaty on Extradition contained in the annex to General Assembly resolution 45/116.

With regard to subparagraphs (a) and (b) of paragraph 1 of article 2 of the Model Treaty, the Republic of Korea suggested that given that the aim of the Model Treaty was to provide guidelines for a bilateral agreement, the " necessary measures " described in the subparagraphs should be detailed.

The Commission should focus on establishing the general principles that governed extradition and the grounds for refusing extradition, taking into account article 3 (Mandatory grounds for refusal) of the Model Treaty on Extradition, contained in the annex to General Assembly resolution 45/116.
وينبغي للجنة أن تركز على ترسيخ المبادئ العامة التي تحكم التسليم وتوضيح أسباب رفض التسليم، مع مراعاة المادة 3 (الأسباب الإلزامية للرفض) من المعاهدة النموذجية لتسليم المجرمين الواردة في مرفق قرار الجمعية العامة 45/116.

The Republic of Korea noted that article 4 of the Model Treaty adopted articles 7 and 16 of the 1970 UNESCO Convention and that the model treaty prescribed " fair compensation " to any person or institution that in good faith acquired or was in legal possession of cultural property.
22- وذكرت جمهورية كوريا أنَّ المادة 4 من المعاهدة النموذجية اعتمدت المادتين 7 و16 من اتفاقية اليونسكو لعام 1970، وأنَّ المعاهدة النموذجية تنصُّ على أن يكون التعويض " عادلا " لأيِّ شخص يكون قد اقتنى ممتلكات ثقافية بحسن نيّة، أو كانت تلك الممتلكات في حوزته بصورة قانونية، أو لأيِّ مؤسسة تكون قد اقتنت الممتلكات المذكورة بحسن نيّة، أو كانت الممتلكات في حوزتها بصورة قانونية.

The United States pointed out the difficulty of implementing the provisions of article 2, paragraph 1 (c), of the Model Treaty because such legislation would not be constitutional in the United States which can only take reasonable steps, consistent with its Constitution and other applicable laws, to punish persons who engage in such conspiracies when they violate United States law.
55- وأشارت الولايات المتحدة إلى صعوبة تنفيذ أحكام الفقرة 1 (ج) من المادة 2 من المعاهدة النموذجية لأنَّ مثل هذا التشريع لن يكون دستورياً في الولايات المتحدة التي لا يمكن إلاَّ أن تتخذ خطوات معقولة تتماشى مع دستورها وغيره من القوانين المنطبقة، لمعاقبة الأشخاص الضالعين في مثل هذه المؤامرات عند خرقهم لقانون الولايات المتحدة.

(b) States should consider, when negotiating bilateral or multilateral agreements or arrangements with other States, making use of the Model Treaty on Extradition, the Model Treaty on Mutual Assistance in Criminal Matters, the Model Agreement on the Transfer of Foreign Prisoners, the Model Bilateral Agreement on the Sharing of Confiscated Proceeds of Crime or Property and other relevant model instruments;
(ب) ينبغي أن تنظر الدول، عند التفاوض على إبرام اتفاقات أو ترتيبات ثنائية أو متعدِّدة الأطراف مع غيرها من الدول، في الاستفادة من المعاهدة النموذجية لتسليم المجرمين، والمعاهدة النموذجية لتبادل المساعدة في المسائل الجنائية، والاتفاق النموذجي بشأن نقل السجناء الأجانب، والاتفاق الثنائي النموذجي بشأن اقتسام العائدات الإجرامية أو الممتلكات المصادرة، وغير ذلك من الصكوك النموذجية ذات الصلة بالموضوع؛
