The procuring entity, upon analysing the reasons leading to the cancellation, may decide that another ERA would be appropriate, for example if mistakes in the description that caused a failure of sufficient number of suppliers or contractors to register for the auction can be rectified, or may choose another procurement method.
وقد تقرِّر الجهة المشترية، لدى تحليل الأسباب المؤدّية إلى الإلغاء، أنَّ من المناسب إجراء مناقصة أخرى، على سبيل المثال إذا أمكن تصحيح أخطاء في الوصف أدت إلى عدم تسجيل عدد كافٍ من المورِّدين أو المقاولين لدخول المناقصة، أو قد تختار تلك الجهة طريقة اشتراء أخرى.

There is no requirement for either a minimum or a maximum number of suppliers or contractors parties to a framework agreement.
10- ولا يوجد شرط بعدد أدنى ولا أقصى من المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري.

The provisions require sending notification individually to each supplier or contractor concerned.
وتشترط الأحكام إرسال إبلاغ إلى كل واحد من المورِّدين أو المقاولين المعنيين.

Article 15. Inducements from suppliers or contractors
المادة 15- الإغراءات المقدّمة من المورِّدين أو المقاولين

Where a minimum and/or a maximum of suppliers or contractors is or are to be imposed, the relevant number(s) must be notified in the solicitation documents.
12- وعندما يُفرض عدد أدنى و/أو أقصى من المورِّدين أو المقاولين، فيجب أن تُعلن الأعداد ذات الصلة في وثائق الالتماس.

This excludes solicitation addressed to a limited number of suppliers or contractors following pre-qualification or preselection proceedings;
وهذا لا يشمل ذلك الالتماس الموجّه إلى عدد محدود من المورِّدين أو المقاولين عقب إجراءات التأهيل الأوّلي أو الاختيار الأوّلي؛

3. Where the procuring entity engages in procurement by means of competitive negotiations in accordance with paragraph 4 of article 30 of this Law, it shall engage in negotiations with a sufficient number of suppliers or contractors to ensure effective competition.
3- عندما تقوم الجهة المشترية بالاشتراء بواسطة التفاوض التنافسي وفقاً للفقرة 4 من المادة 30 من هذا القانون، تُجري مفاوضات مع عدد كاف من المورِّدين أو المقاولين ضماناً للتنافس الفعال.

This requirement is intended to ensure objectivity in the process, and to avoid the misuse of the procedure through invoking criteria intended to favour a particular supplier or contractor or group of suppliers or contractors.
والقصد من هذا الاشتراط هو ضمان توخّي الموضوعية في العملية وتفادي إساءة استخدام الإجراء من خلال الاستناد إلى معايير يُقصد بها محاباة أحد المورِّدين أو المقاولين أو مجموعة معيّنة من المورِّدين أو المقاولين.

1. The procurement regulations or other provisions of law of the enacting State must set out the exceptional conditions under which the procuring entity may limit the participation of certain categories of suppliers or contractors in procurement proceedings.
1- يجب أن تبين لوائح الاشتراء أو أحكام أخرى من قانون الدولة المشترعة الأحوال الاستثنائية التي يجوز فيها للدولة المشترعة أن تحدّ من مشاركة فئات معينة من المورِّدين أو المقاولين في إجراءات الاشتراء.

5. Direct solicitation is an inherent feature of this procurement method since the solicitation in this procurement method is addressed to a limited number of suppliers or contractors identified by the procuring entity.
5- والالتماس المباشر سمة متأصلة في طريقة الاشتراء هذه نظرا لأنَّ الالتماس في طريقة الاشتراء هذه موجَّه إلى عدد محدود من المورِّدين أو المقاولين الذين تحددهم الجهة المشترية.

3. In the context of a multi-supplier closed framework agreement, the procurement regulations must guide the procuring entity on whether setting either a minimum or a maximum number of suppliers or contractors parties to a framework agreement or both would be appropriate and, if so, what to consider in doing so.
3- وفي سياق الاتفاق الإطاري المغلق المتعدد المورِّدين، يجب على لوائح الاشتراء أن ترشد الجهة المشترية بشأن ما إذا كان من المناسب تحديد عدد أدنى أو أقصى من المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري أو كليهما، وفي هذه الحالة ما ينبغي النظر فيه تحقيقا لذلك.

The procurement regulations must address situations where the stated minimum may not be achieved by requiring the procuring entity to specify in the solicitation documents the steps that it will then take, which might involve the cancellation of the procurement or the conclusion of the framework agreement with a lower number of suppliers or contractors.
ويجب على لوائح الاشتراء أن تتناول الحالات التي قد لا يتحقق فيها العدد الأدنى المنصوص عليه بأن تشترط على الجهة المشترية أن تحدد في وثائق الالتماس الخطوات التي سوف تتخذها عندئذ والتي قد تنطوي على إلغاء الاشتراء أو إبرام الاتفاق الإطاري مع عدد أقلّ من المورِّدين أو المقاولين.

(d) A maximum number of suppliers or contractors parties to the framework agreement, if any, and the procedure and criteria for the selection of that maximum.
(د) عدد أقصى من المورِّدين أو المقاولين الأطراف في الاتفاق الإطاري، إن وُجد، وإجراءات ومعايير اختيار ذلك العدد الأقصى.

They may provide examples when issuing an invitation to a limited group of suppliers or contractors then capable of meeting the needs of the procuring entity in the subject matter of the procurement will be justified.
ويجوز أن تقدِّم اللوائح أمثلة على الحالات التي يكون فيها إصدار دعوة إلى مجموعة محدودة من المورِّدين أو المقاولين القادرين في ذلك الحين على تلبية احتياجات الجهة المشترية فيما يخص الشيء موضوع الاشتراء مبرَّرا.

This excludes solicitation addressed to a limited number of suppliers or contractors following pre-qualification or pre-selection proceedings. "
وهذا لا يشمل الالتماس الموجَّه إلى عدد محدود من المورِّدين أو المقاولين عقب إجراءات التأهيل الأولي أو الاختيار الأولي. "

This however should not be construed as implying that procuring entities' information systems have to be interoperable with those of each single supplier or contractor.
إلاّ أنَّ ذلك لا ينبغي أن يفسّر على أنَّه يعني أنَّ نظم المعلومات الخاصة بالجهة المشترية يجب أن تكون قابلة للاستخدام التبادلي مع نظم كل واحد من المورِّدين أو المقاولين.

Depending on the subject matter of the procurement and the stage of the procurement proceedings at which qualification criteria are assessed, a self-declaration from suppliers or contractors may or may not be sufficient.
ورهنا بالشيء موضوع الاشتراء ومرحلة إجراءات الاشتراء التي يجري عندها تقييم معايير التأهيل، قد يكون صدور إعلان ذاتي من المورِّدين أو المقاولين كافيا أو غير كاف.

This requirement avoids the risk that information supplied by suppliers or contractors in their submissions will be used improperly, for example by revealing it to competitors.
وهذا الشرط يمكِّن من اجتناب خطر استعمال المعلومات المقدَّمة من المورِّدين أو المقاولين في عروضهم استعمالا غير سليم مثلا بكشفها للمنافسين.

A maximum number may be appropriate, for example, where the procuring entity envisages that there will be more qualified suppliers or contractors presenting responsive submissions than can be accommodated.
