While it is established that such a reservation cannot produce legal effects, it is essential to answer the question of whether its author becomes a contracting party without the benefit of its reservation, or whether the nullity of its reservation also affects its consent to be bound by the treaty.

Guideline 4.5.2, in particular, introduced a new presumption in the case of an impermissible reservation -- namely, that the reserving State would become a party to the treaty in question without the benefit of its reservation unless it clearly indicated that it did not wish to be bound by the treaty under those circumstances.

In its general comment No. 24 the Human Rights Committee, for example, had highlighted two fundamental elements: first, that a human rights treaty body had the competence to address the permissibility of reservations and, second, that the usual consequence of an impermissible reservation would be its severance, which would mean that the State in question was considered to be bound by the treaty without the benefit of its reservation.

The draft Guide's proposed positive presumption claims that an impermissible reservation is devoid of legal effect (draft guideline 4.5.1) and that, as a result, the reserving State is considered a contracting party without the benefit of its reservation unless a contrary intention of the said State can be identified.
