New technologies facilitate the secrecy in that illegal trade, making it difficult to identify the number of cases, including cases of sale of children for the purpose of transfer of organs.

The Optional Protocol calls on States parties to prohibit the sale of children, child prostitution and child pornography and to criminalize in their national legislation as a minimum, inter alia, the offering, delivering or accepting of children for purposes of sexual exploitation, transfer of organs for profit or engagement in forced labour.

It does not criminalize the sale of children for the purpose of transfer of organs of the child for profit or engagement of the child in forced labour, and it does not explicitly cover prostitution of children 14 years of age or older, nor the possession of pornographic material.
فقانون العقوبات لا يجرم بيع الأطفال لأغراض نقل الأعضاء تحقيقاً للربح أو استخدام الطفل في العمل القسري، ولا يتناول صراحة بغاء الأطفال الذين بلغوا 14 عاماً أو أكثر، ولا حيازة مواد إباحية.

The Kuwaiti legislature imposes strict rules on the transfer of organs, creating tough laws to deal with anyone who transfers human organs from a deceased person without obtaining prior consent from that person while he or she was alive, or from his or her relatives after the death. This is intended to increase protection for human rights.

41. The Committee is concerned that in light of recent cases of offering, delivering or accepting of a child for the transfer of organs for profit and that this crime is not prohibited and criminalized, in accordance with article 3, paragraph 1, of the Optional Protocol.
41- ويساور اللجنة القلق لأنه على ضوء الحالات التي جرت مؤخراً فيما يتعلق بعرض الأطفال أو تسليمهم أو قبولهم لأغراض نقل الأعضاء تحقيقاً للربح،فإن هذه الجريمة لا تُحظر ولا تُجرّم، وفق ما تقتضيه الفقرة 1 من المادة 3 من البروتوكول الاختياري.

44. CRC recommended that Yemen criminalize the sale of children for the purpose of transfer of organs for profit, and bring perpetrators to justice.
44- وأوصت لجنة حقوق الطفل بأن يُجرّم اليمن بيع الأطفال لغرض نقل الأعضاء من أجل الربح وبتسليم الجناة إلى العدالة(104).

Every person who traffics in organs for transplanting shall be liable to a term of imprisonment at hard labour and a fine of LS 50,000 to LS 100,000. (Decree regulating the transfer of organs).
ويعاقب بالأشغال الشاقة المؤقتة وبالغرامة من 000 50 إلى 000 100 ليرة سورية كل من يقوم بالاتجار بنقل الأعضاء (المادة 7 من قانون تنظيم نقل الأعضاء).

Although there are no laws on this subject, the draft amendments to the Code of Offences and Penalties which have been approved by the Cabinet and submitted to the House of Representatives for consideration and adoption do contain provisions designed to prevent the transfer of organs for profit (see paragraph 21 above).

25. Article 3 of the Optional Protocol defines the sale of children for the purpose of organ transfers as " offering, delivering or accepting " a child for the purpose of " transfer of organs of the child for profit " .

36. Methods used to identify child victims must enable professionals to distinguish whether a child who was sold was victimized for the purpose of sexual exploitation, forced labour, begging, illegal adoption or the transfer of organs.
36 - ويجب تحديد الطرائق المستخدمة للتعرف على الأطفال الضحايا بحيث تمكِّن الاختصاصيين من معرفة ما إذا كان الطفل الضحية قد تم بيعه بغرض الاستغلال الجنسي أو العمل القسري أو التسول أو التبني غير المشروع أو نقل الأعضاء.

Although the Committee understands there are ongoing efforts to reform the Guatemalan Penal Code, the Committee is seriously concerned that the sale of children, adoption practices, organ transfer for profit, sexual and economic exploitation of children and the production and distribution of pornography have not been adequately addressed in the national legislation.

(c) Children offered, delivered, accepted by whatever means for the purpose of prostitution, engagement in forced labour, illegal adoptions, organ transfer, pornography or marriage; and

The actual extent, however, of the various forms of the sale -- especially sale for illegal adoption or for organ transfers -- and of sexual exploitation of children remained difficult to assess, in part because of inadequate information systems, the small number of reports and complaints and the clandestine nature of the offences.

21. In February 2011, China introduced the death penalty for forced organ removal from juveniles resulting in death.

As for the causes of transmission of the infection to women, 31.4% of all women with the disease were infected by blood transfusion, 30.6% by sexual contact, 25.9% by cause unknown, 10.4% by transmission from mother to child, 1.5% by organ transplant and 0.2% as a result of drug addiction.

The Working Group requested the Special Rapporteur, within the framework of her mandate, to continue to pay attention to issues relating to the traffic in children, such as organ transplantation.
