Nevertheless, it would not require Parties to ban or eliminate such mining in their countries; the question of whether to ban or eliminate mercury use in such mining would be for individual Parties to decide at their own discretion.

Several representatives commended the work of UNEP and the partnership area on artisanal and small-scale gold mining under the Global Mercury Partnership, including efforts to support Governments in the development of national and regional strategic plans for dealing with mercury use in such mining.

If the Committee decided that primary mining should continue to be allowed as a source for mercury, then it could include such mining among the supply sources listed in Annex A, as has been proposed under the eighth listing entry below.
