• hukou

The hukou system is based on the household, and is regularly updated when people no longer live in the country or die.
ويقوم نظام التسجيل " هوكو " على الأسرة ويُعدّل بانتظام عند مغادرة البلد أو عند الوفاة.

While it is possible to obtain an identity card at the age of 16, the hukou is a prerequisite.
وحتى إذا كان من الممكن الحصول على بطاقة هوية اعتباراً من سن السادسة عشرة، فإن وثيقة التسجيل " هوكو " تبقى وثيقة إلزامية.

The State party affirms that based on information from its Ministry of Foreign Affairs, every family in China has a hukou Ben, which is a household booklet reflecting information such as birth, civil status, marriage and death.

Any Chinese national can be registered under the hukou system, even at an advanced stage in life, and even after a protracted stay abroad, even though bureaucratic obstacles may sometimes delay the process of registration.

48. The Committee notes with concern that due to the restrictive hukou policy, many migrant parents face the difficult choice of leaving their children behind, resulting in 55 million children growing up without one or both parents in rural mainland China.

49. In accordance with article 9 of the Convention, the Committee urges the State party to take immediate measures to avoid the separation of children from the family environment, including by abolishing the hukou system and providing appropriate assistance and support services to parents and legal guardians, including to working parents, in the performance of child-rearing responsibilities.
49- تماشياً مع المادة 9 من الاتفاقية، تحث اللجنة الدولة الطرف على اتخاذ تدابير فورية لتجنب فصل الأطفال عن بيئتهم الأسرية، بوسائل منها إلغاء نظام هوكو وتوفير خدمات المساعدة والدعم الملائمة للآباء والأوصياء القانونيين، بمن فيهم الآباء العاملون، في أداء مسؤولياتهم المتعلقة بتنشئة الأطفال.

4.2 On 7 May 2008, the State party further states that the author's allegation that he will be denied access to social advantages in China, for lack of a hukou registration, was not raised before the Courts of the State party.
4-2 وفي 7 أيار/مايو 2008، أشارت الدولة الطرف كذلك إلى أن صاحب البلاغ لم يرفع أمام محاكمها إدعاءه بأنه سيُحرم من حق الاستفادة من المساعدات الاجتماعية في الصين لعدم امتلاكه وثيقة التسجيل " هوكو " .

He has not submitted any official document supporting his allegations, and did not ask the Chinese diplomatic representation in the Netherlands about his hukou registration, so as to be able to credibly establish that he would not be able to prove his identity in China and, as a result, be denied the associated social benefits.

Concerning article 7, he claims that he would be exposed to inhumane treatment or degrading treatment or punishment if returned to China, as he left China at the age of 15 years old, without a hukou registration, which is obtained by adults.

He had been deprived of his identity card by the State party's authorities at the end of the negative asylum procedure. In addition, he was unable to obtain a passport since he could not prove his Chinese origin and did not have a valid hukou registration.

17. CERD was concerned at the de facto discrimination against internal migrants and recommended that China implement its decision to reform the national household registration system (hukou) and ensure that internal migrants, in particular members of ethnic minorities, would be able to enjoy the same work, social security, health and education benefits as long-term urban residents.
17- وأعربت اللجنة عن قلقها من التمييز ضد المهاجرين الداخليين على أرض الواقع، وأوصت الصين بتنفيذ قرارها المتعلق بإصلاح النظام الوطني لتسجيل الأُسر المعيشية (هوكو) وضمان تمكين المهاجرين الداخليين، ولا سيما أفراد الأقليات الإثنية، من التمتع بنفس استحقاقات العمل والضمان الاجتماعي والصحة والتعليم على غرار السكان الحضريين على المدى الطويل(65).

(14) While noting the ongoing reforms of the national household registration system (hukou), the Committee is concerned at the de facto discrimination against internal migrants in the fields of employment, social security, health services and education that indirectly result from that system, which also affects members of ethnic minorities, and in particular women (arts. 5 (a) and 2).

The Committee reiterates its previous recommendation (E/C.12/1/Add.107, para. 46) and calls upon the State party to strengthen its efforts to abolish the household registration system (hukou) and to ensure that all rural-to-urban migrants are able to enjoy the work opportunities, as well as social security, housing, health and education benefits, enjoyed by residents in urban areas.
تكرر اللجنة توصيتها السابقة (E/C.12/1/Add.107، الفقرة 46) وتدعو الدولة الطرف إلى تعزيز جهودها الرامية إلى إلغاء نظام تسجيل الأسر المعيشية (هوكو) والسهر على تمتع السكان النازحين من الأرياف إلى المدن، في أي نظام يحل محله يتمتع به سكان المناطق الحضرية، بنفس مزايا العمل والضمان الاجتماعي والصحة والتعليم.

The Chinese government is therefore considering several policies to increase the pace of urbanization, including the creation of several new large cities to accommodate some of the 600 million individuals who still live in rural China. Similarly, the government will phase out the hukou system of residency permits that now prevents migrants to the cities from obtaining full health care and education benefits.
