The duty to investigate human rights abuses has been further reiterated and confirmed in a number of international instruments, including the Declaration on the Protection of All Persons from Enforced Disappearance and the Principles on the Effective Prevention of and Investigations of Extra-legal, Arbitrary and Summary Executions.E/CN.4/1999/39
وقد تكرر التأكيد على الالتزام بالتحقيق في انتهاكات حقوق الإنسان والتشديد على ذلك الالتزام، في عدة وثائق دولية، بما فيها الإعلان المتعلق بحماية جميع الأشخاص من الاختفاء القسري، ومبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج القضاء والإعدام التعسفي والإعدام دون محاكمة.

a. Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions (Economic and Social Council resolution 1989/65, annex);
أ- المبادئ المعنية بالمنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة (قرار المجلس 1989/65، المرفق)؛

77. The Commission furthermore recommends that the Government of Togo should adopt legislative and other measures to punish and prevent the perpetration of such violations, in conformity inter alia with the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions.
77- وتوصي اللجنة كذلك الحكومة التوغولية باعتماد تدابير تشريعية أو غيرها لوضع حد لمثل هذه الانتهاكات ومنع ارتكابها، لا سيما طبقا ل " مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة " .

60. In this connection, the Special Rapporteur wishes again to draw attention to the standards pertaining to the investigation of extrajudicial executions contained in the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions.
60- وتود المقررة الخاصة في هذا الصدد أن توجه الاهتمام مرة أخرى إلى المعايير المتعلقة بالتحقيق في حالات الإعدام خارج نطاق القضاء الواردة في مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة.

(a) This declaration of strict enforcement is also affirmed by the Principles on the Effective Prevention and Investigation of Extra-Legal, Arbitrary and Summary Executions.
(أ) يرد تأكيد هذا الإعلان بشأن التطبيق الصارم أيضاً في مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة.

Finally, and in suspected cases of extra-legal, arbitrary and Summary Executions, the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions (1989) also apply to situations in which death occurs in custody.
وأخيرا، في الحالات التي يُشتبه أنها تنطوي على عمليات إعدام خارج نطاق القانون وإعدام تعسفي وإعدام دون محاكمة، تطبّق مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة بإجراءات موجزة (1989) أيضا على الحالات التي تقع فيها الوفاة أثناء الاحتجاز.

(b) This principle is affirmed by the Basic Principles on the Use of Force and Firearms by Law Enforcement Officials, the Code of Conduct for Law Enforcement Officials, and the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.
(ب) يرد تأكيد هذا المبدأ في المبادئ الأساسية بشأن استخدام القوة والأسلحة النارية من جانب الموظفين المكلفين بإنفاذ القوانين، ومدونة قواعد سلوك الموظفين المكلفين بإنفاذ القوانين، ومبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة.

25. In this connection, the Special Rapporteur wishes to draw attention to the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions (Economic and Social Council resolution 1989/65), and in particular paragraphs 12 and 13, which include important provisions as regards the conduct of autopsies.
25- وترغب المقررة الخاصة أن تلفت الانتباه في هذا الصدد إلى مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعدام دون محاكمة (قرار المجلس الاقتصادي والاجتماعي 1989/65)، وعلى وجه الخصوص إلى الفقرتين 12 و13 منه اللتين تضمان أحكاماً هامة فيما يتعلق بتشريح الجثث.

These facilities should be upgraded as a matter of urgency in connection with initiatives aimed at strengthening the criminal justice system in Nepal, so as to allow for autopsies and other forensic examinations to be conducted in accordance with international standards, including those contained in the Principles for the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.
وينبغي الارتقاء بمستوى هذه المرافق على سبيل الاستعجال فيما يتصل بالمبادرات الهادفة إلى النهوض بنظام القضاء الجنائي في نيبال، بحيث يفسح المجال لإجراء تشريح الجثث وغيرها من فحوصات الطب الشرعي وفق المعايير الدولية، بما فيها تلك الواردة في مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج القضاء والإعدام التعسفي والإعدام دون محاكمة.

These further investigations should be carried out promptly and in accordance with international standards, notably the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions (see above) and the 1995 Guidelines for the conduct of United Nations inquiries into allegations of massacres.

While this formulation is taken from principle 15 of the principles on the effective prevention and investigation of extra-legal, arbitrary and Summary Executions (Economic and Social Council resolution 1989/65, annex), the same approach was repeatedly endorsed by the Commission on Human Rights.

It was unacceptable that under the pretext of counter-terrorism, some States committed acts of aggression, intervened in the internal affairs of other States, and committed or allowed the commission of flagrant violations of human rights and international humanitarian law, such as torture, abduction, unlawful detention, forced disappearance and extrajudicial execution.
ومن غير المقبول أن يعمد بعض الدول، بدعوى مكافحة الإرهاب، إلى ارتكاب أعمال عدوانية، والتدخل في الشؤون الداخلية لدول أخرى، وارتكاب أو السماح بارتكاب انتهاكات جسيمة لحقوق الإنسان والقانون الإنساني الدولي، كالتعذيب، والاختطاف، والاحتجاز غير القانوني، والاختفاء القسري، والإعدام دون محاكمة.

It was unacceptable that, under the pretext of counter-terrorism, some States committed acts of aggression, interfered in the internal affairs of other States, including through support for regime change, and committed flagrant violations of human rights and international humanitarian law, such as torture, abduction, unlawful detention, forced disappearance and extrajudicial execution.
