وعند إثبات أية تهمة جنائية ضدهم، أو تحديد حقوقهم والتزاماتهم في دعوى قضائية، يكون من حقهم سماع أقوالهم بطريقة عادلة وعلنية أمام محكمة مختصة ومستقلة ونزيهة تعقد وفقاً للقانون.

7.7 The Committee recalls that the right to a fair and public hearing by a competent, independent and impartial tribunal is guaranteed in cases regarding the determination of criminal charges against individuals or of their rights and obligations in a suit at law.
7-7 وتشير اللجنة إلى أن الحق في محاكمة عادلة وعلنية أمام محكمة مختصة ومستقلة ونزيهة مضمون في القضايا المتعلقة بالفصل في الاتهامات الجنائية الموجهة للأفراد أو في حقوقهم والتزاماتهم في أية دعوى قضائية.
