٥ - وبالقرار ٤٤/٨٢١ المؤرخ ٥١ كانون اﻷول/ديسمبر ٩٨٩١ اعتمـدت الجمعيـة العامة البروتوكول الاختياري الثاني للعهد الدولي الخاص بالحقوق المدنية والسياسية الذي يستهدف إلغاء عقوبة اﻹعدام، وفتحت باب التوقيع عليه والتصديق عليه والانضمام إليه، وطلبت إلى جميع الحكومات التي هي في وضع يسمح لها بالنظر في التوقيع على البروتوكول الاختياري الثاني والتصديق عليه أو الانضمام إليه أن تفعل ذلك.

٣- وقد قامت الجمعية العامة، بقرارها ٤٤/٨٢١ المؤرخ في ٥١ كانون اﻷول/ديسمبر ٩٨٩١، باعتماد البروتوكول الاختياري الثاني الملحق بالعهد الدولي الخاص بالحقوق المدنية والسياسية الذي يستهدف إلغاء عقوبة اﻹعدام، وفتحت باب التوقيع والتصديق عليه والانضمام إليه، وطلبت إلى جميع الحكومات التي هي في وضع يسمح لها بالنظر في التوقيع على البروتوكول الاختياري الثاني والتصديق عليه أو الانضمام إليه أن تفعل ذلك.

3. Recommends to the General Assembly that it adopt and open for signature, ratification and accession as early as possible the optional protocol to the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
3- يوصي الجمعية العامة باعتماد البروتوكول الاختياري لاتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة وفتح باب التوقيع والتصديق عليه أو الانضمام إليه في أسرع وقت ممكن.
