Decides to adopt the Basic Principles and guidelines on the right to a Remedy and Reparation for Victims of Violations of International Human Rights and Humanitarian Law as follows:
تقرر اعتماد المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي، وهذه المبادئ والخطوط هي:

1. Basic principles and guidelines on the right to reparation for victims of gross violations of human rights and humanitarian law.
١- المبادئ اﻷساسية والخطوط التوجيهية بشأن الحق في الجبر لضحايا الانتهاكات الجسيمة لحقوق الانسان والقانون الانساني.

Reference was made to the current efforts to draft basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and international humanitarian law.
وتم التذكير، وفي جملة أمور أخرى، بالأعمال الجارية لوضع المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي.

54. Mr. van Boven then addressed the types of remedies available and made reference to the draft Basic Principles and guidelines on the right to Reparation for Victims of Gross Violations of Human Rights and International Humanitarian Law.

It will be recalled that it was in the Sub-Commission that the basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law were first discussed.
12- ويجدر بالذكر أن المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف وجبر الأضرار لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي قد نوقشت لأول مرة في اللجنة الفرعية.

43. The scope of this principle has been generalized in the draft Basic Principles and guidelines on the right to a Remedy and Reparation for Victims of Violations of International Human Rights and Humanitarian Law which, in its principle 25 (i) refers to:

69. The Chairperson-Rapporteur of the consultative meeting on the draft Basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law recommends that the Commission on Human Rights:
69- يوصي رئيس - مقرر الاجتماع الاستشاري المعني بمشروع المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصـاف والجـبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي، لجنة حقوق الإنسـان بما يلي:

135. At the present session the Sub-Commission will have before it the revised set of basic principles and guidelines on the right to reparation for victims of gross violations of human rights and humanitarian law prepared by Mr. van Boven (E/CN.4/Sub.2/1996/17).

186. At its forty—eighth session the Sub—Commission had before it the revised set of basic principles and guidelines on the right to reparation for victims of gross violations of human rights and humanitarian law prepared by Mr. van Boven (E/CN.4/Sub.2/1996/17).
٦٨١- وفي الدورة الثامنة واﻷربعين، كان معروضاً على اللجنة الفرعية مجموعة منقحة من المبادئ اﻷساسية والخطوط التوجيهية بشأن الحق في التعويض لضحايا الانتهاكات الجسيمة لحقوق اﻹنسان والقانون اﻹنساني، وكان قد أعدها السيد فان بوفن )E/CN.4/Sub.2/1996/17(.

Bassiouni's revision, the " Basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law " (Basic Principles), was adopted by the Commission on Human Rights on 20 April 2000.
أما النسخة التي أعدها بسيوني " المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف وجبر الأضرار بالنسبة لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي " (المبادئ الأساسية)() فقد اعتمدتها لجنة حقوق الإنسان في 20 نيسان/أبريل 2000().

2. Takes note of the report of the ChairpersonRapporteur of the second consultative meeting on basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law (E/CN.4/2004/57, annex), held in Geneva on 20, 21 and 23 October 2003;
2- تحيط علماً بتقرير رئيس - مقرر الاجتماع الاستشاري الثاني بخصوص المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات قانون حقوق الإنسان الدولي والقانون الإنساني الدولي (E/CN.4/2004/57، المرفق) المعقود في 20 و21 و23 تشرين الأول/ أكتوبر 2003؛

(a) Establish, at its next session, an appropriate and effective mechanism with the objective of finalizing the elaboration of the set of Basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law, contained in the annex to document E/CN.4/2000/62;
(أ) أن تنشأ، في دورتها المقبلة، آلية مناسبة وفعالة يكون هدفها وضع الصيغة النهائية لمجموعة المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي، الواردة في الوثيقة E/CN.4/2000/62؛

2. Requests the Secretary-General to circulate to all Member States the text of the " Basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law " , annexed to the final report of the independent expert and to request that they send their comments thereon to the Office of the United Nations High Commissioner for Human Rights;
2- تطلب إلى الأمين العام أن يعمم على كافة الدول الأعضاء نص " المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الأساسي الدولي " الوارد في مرفق التقرير النهائي للخبير المستقل، وأن يطلب منها إرسال تعليقاتها عليه إلى مفوضية الأمم المتحدة السامية لحقوق الإنسان؛

126. In its resolution 2000/41, the Commission requested the Secretary-General to circulate to all Member States the text of the " Basic principles and guidelines on the right to a remedy and reparation for victims of violations of international human rights and humanitarian law " , annexed to the final report of the independent expert and to request their comments thereon.
126- وطلبت اللجنة إلى الأمين العام، في قرارها 2000/41، أن يعمّم على كافة الدول الأعضاء نص " المبادئ الأساسية والخطوط التوجيهية بشأن الحق في الانتصاف والجبر لضحايا انتهاكات حقوق الإنسان الدولية والقانون الإنساني الدولي " ، الوارد في مرفق التقرير النهائي للخبير المستقل، وأن يطلب منها إرسال تعليقاتها عليه.
