During 1994, the Special Rapporteur continued to receive reports indicating that legislation and practice relating to capital punishment in the United States of America did not conform to internationally recognized standards for fair trials.

37. Turning to the law and practice relating to reservations to treaties, he noted that the rules set forth in the Vienna Convention on the Law of Treaties were being applied and innumerable State practices had already developed on the basis of those rules.
٣٧ - وانتقل الى موضوع القانون والممارسة المتعلقين بالتحفظات على المعاهدات، وأشار الى أن القواعد المنصوص عليها في اتفاقية فيينا لقانون المعاهدات هي قواعد مطبقة بالفعل، كما تم بالفعل تطبيق عدد لا يحصى من ممارسات الدول استنادا الى تلك القواعد.

54. Concerning the law and practice relating to reservations to treaties, the document considered the current situation relating to reservations under international law in an objective and comprehensive manner.
٥٤ - وعن القانون والممارسة المتعلقين بالتحفظات على المعاهدات قالت إن الوثيقة تنظر بصورة موضوعية وشاملة في الوضع الراهن المتصل بالتحفظات بموجب القانون الدولي.

With regard to the issue of State succession and its impact on the nationality of natural and legal persons, he welcomed the progress made by the Commission during its latest session and he also commended it on the approach it had taken to the issue of the law and practice relating to reservations to treaties.
٤٢ - وفيما يتعلق بموضوع خلافة الدول وأثرها على جنسية اﻷشخاص الطبيعيين والاعتباريين، أعرب عن ترحيبه بالتقدم الذي أحرزته اللجنة خلال دورتها اﻷخيرة كما أشاد بها للنهج الذي اتبعته تجاه موضوع القانون والممارسة المتعلقين بالتحفظات على المعاهدات.

70. The Special Rapporteur on the law and practice relating to reservations to treaties had underlined the ambiguities and gaps in the system established by the Vienna Conventions and had identified the questions to be addressed in the Commission.
٧٠ - وتابع حديثه قائلا إن المقرر الخاص المعني بالقانون والممارسة المتعلقين بالتحفظات على المعاهدات أبرز مواطن الغموض والثغرات في النظام الذي أنشأته اتفاقيات فيينا وحدد المسائل التي يتعين أن تناقش في اللجنة.

12. Mr. ROBINSON (Jamaica), referring to the topic of the law and practice relating to reservations to treaties, said that treaties had a great impact on the maintenance of international peace, stability and security.
١٢ - السيد روبينسون )جامايكا(: أشار الى موضوع القانون والممارسة المتعلقين بالتحفظات على المعاهدات، فقال إن المعاهدات لها أثر كبير في المحافظة على السلم والاستقرار واﻷمن الدوليين.

93. With regard to the law and practice relating to reservations to treaties, his delegation endorsed the views held by the Special Rapporteur as well as his arguments for drafting model clauses and guidelines for the regime of reservations.
٩٣ - وفيما يتعلق بالقانون والممارسة المتعلقين بالتحفظات على المعاهدات، قال إن وفد بلده يؤيد اﻵراء التي أعرب عنها المقرر الخاص فضلا عن الحجج التي قدمها لصياغة شروط نموذجية ومبادئ توجيهية تتعلق بنظام التحفظات.

In conclusion, he welcomed the appointment of the two Special Rapporteurs for the topics " The law and practice relating to reservations to treaties " and " State succession and its impact on the nationality of natural and legal persons " , respectively, which were both of great practical value and highly relevant.
وفي الختام، أعرب السيد هيلغر عن ترحيبه بتعيين مقررين خاصين لموضوع " القانون والممارسة المتعلقين بالتحفظات على المعاهدات " وموضوع " خلافة الدول وأثرها على جنسية اﻷشخاص الطبيعيين والاعتباريين " ، وهما موضوعان لهما أهمية عملية كبيرة ويعدان بلا شك من مواضيع الساعة.

65. With regard to the law and practice relating to reservations to treaties, his delegation was aware of the importance and technical nature of what was a complicated issue, for which there were, however, well-established principles and standards. If the Commission must fill in the gaps and clarify the ambiguities in existing texts, it should do so with great care and diligence.
٦٥ - وتطرق إلى القانون والممارسة المتعلقين بالتحفظات على المعاهدات فقال إن وفده يدرك أهمية هذه المسألة المعقدة وما تتسم به من طابع تقني، ولكن توجد بخصوصها مبادئ ومعايير راسخة، وإذا كان لا بد من أن تسد اللجنة الثغرات وتوضح مواطن الغموض في النصوص القائمة، فينبغي أن تفعل ذلك بقدر كبير من العناية والمثابرة.

94. Mr. REZAEIAN (Islamic Republic of Iran), speaking in exercise of the right of reply, referred to the remarks made by the representative of Austria concerning the law and practice relating to reservations to treaties and said that objections by States to reservations made by other States were normally addressed through the depositary of the treaty in question.
٩٤ - السيد رضائيان )جمهورية إيران اﻹسلامية(: تكلم في إطار ممارسة حق الرد، فإشار إلى الملاحظات التي أبداها ممثل النمسا فيما يتعلق بالقانون والممارسة المتعلقين بالتحفظات على المعاهدات. وقال إن الاعتراضات التي تقدمها الدول على التحفظات التي تبديها الدول اﻷخرى تقدم عادة عن طريق الجهة الوديعة للمعاهدة التي يتعلق بها اﻷمر.

Since then, the agenda of every meeting of CAHDI has included an item entitled " Law and practice relating to reservations and interpretative declarations concerning international treaties: European Observatory of Reservations to International Treaties " and a " List of outstanding reservations and declarations to international treaties " and a " Table of objections " are prepared by the secretariat for consideration.
