" 2. Decides that a part of the sum in the account administered by the Secretary-General shall be made available by him to finance the purchase of foodstuffs, medicines and materials and supplies for essential civilian needs, as referred to in paragraph 20 of resolution 687 (1991), and the cost to the United Nations of its roles under this resolution and of other necessary humanitarian activities in Iraq;
" ٢ - يقرر أن يقوم اﻷمين العام باتاحة جزء من المبلغ المودع في الحساب الذي يقوم بادارته وذلك لتمويل شراء المواد الغذائية، واﻷدوية والمواد واﻹمدادات اللازمة لتلبية احتياجات مدنية أساسية، على النحو المشار إليه في الفقرة ٢٠ من القرار ٦٨٧ ، والتكاليف التي تتكبدها اﻷمم المتحدة فيما يتعلق بدورها، بموجب هذا القرار، وتكاليف اﻷنشطة الانسانية الضرورية اﻷخرى في العراق؛

" In the course of consultations it was noted that resolutions 706 (1991) and 712 (1991) gave to Iraq the possibility for oil sales to finance the purchase of foodstuffs, medicines and materials and supplies for essential civilian needs for the purpose of providing humanitarian relief.
" وأثناء المشاورات، لوحظ أن القرارين ٧٠٦ )١٩٩١( و ٧١٢ )١٩٩١( أتاحا للعراق إمكانية بيع النفط لتمويل شراء المواد الغذائية واﻷدوية والمواد واﻹمدادات اللازمة لتلبية احتياجات مدنية أساسية بغرض توفير اﻹغاثة اﻹنسانية.

(a) To finance the export to Iraq, in accordance with the procedures of the Committee established by resolution 661 (1990), of medicine, health supplies, foodstuffs, and materials and supplies for essential civilian needs, as referred to in paragraph 20 of resolution 687 (1991) provided that:
)أ( تمويل تصدير اﻷدوية واللوازم الصحية والمواد الغذائية والمواد واﻹمدادات اللازمة للاحتياجات المدنية اﻷساسية، إلى العراق، وفقا ﻹجراءات اللجنــة المنشأة بموجــب القرار ٦٦١ )١٩٩٠(، وذلك على النحو المشار إليه في الفقرة ٢٠ من القرار ٦٨٧ )١٩٩١(، رهنا بما يلي:

Consequently, paragraph 20 of resolution 687 (1991) allows States to unfreeze Iraqi assets held within their jurisdictions in order to finance the sale or supply to Iraq of foodstuffs notified to the Sanctions Committee, and of material and supplies for essential civilian needs approved by it.
وبالتالي فإن الفقرة ٢٠ من القرار ٦٨٧ )١٩٩١( تسمح للدول بالافراج عن اﻷصول العراقية الموجودة ضمن ولاياتها لتمويل بيع أو توريد المواد الغذائية التي تخطر بها لجنة الجزاءات، والمواد واﻹمدادات اللازمة لتلبية الاحتياجات المدنية التي توافق عليها اللجنة للعراق.

Security Council resolution 986 (1995) requires that Iraq shall guarantee, on the basis of a plan submitted and approved by the Secretary-General, equitable distribution of medicine, health supplies, foodstuffs and materials and supplies for essential civilian needs (humanitarian supplies) exported to Iraq under the conditions defined by that resolution.

At its 93rd meeting, on 5 May 1993, the Committee decided to request a legal opinion on whether, and if so under what conditions, Iraq's frozen assets may be used as payment for the sale or supplies to Iraq of medicine and health supplies, foodstuffs, as well as materials and supplies for essential civilian needs which have been approved by the Committee, within the scope of the pertinent Security Council resolutions.

Security Council resolutions 986 (1995) of 14 April 1995 and 1153 (1998) require that the Government of Iraq guarantee, on the basis of a plan submitted and approved by the Secretary-General, equitable distribution of medicine, health supplies, foodstuffs and materials and supplies for essential civilian needs (humanitarian supplies) exported to Iraq under conditions defined by those resolutions.

5. The Government of Iraq undertakes to effectively guarantee equitable distribution to the Iraqi population throughout the country of medicine, health supplies, foodstuffs and materials and supplies for essential civilian needs (hereinafter humanitarian supplies) purchased with the proceeds of the sale of Iraqi petroleum and petroleum products.
٥ - تتعهد حكومة العراق بأن تضمن على نحو فعال توزيع اﻷدوية واﻹمدادات الصحية والمواد الغذائية والمؤن واﻹمدادات اللازمة للاحتياجات المدنية اﻷساسية )التي يشار إليها فيما بعد باسم " اﻹمدادات اﻹنسانية " ( التي تشترى من عائدات بيع النفط العراقي والمنتجات النفطية العراقية توزيعا عادلا على السكان العراقيين في شتى أنحاء البلد.

66. At its 102nd meeting, on 14 October 1993, the Committee requested its secretariat to study and make recommendations concerning procedural matters relating to the financing of Iraqi purchases of foodstuffs, medicines and supplies for essential civilian needs through the transfer of Iraqi frozen funds to the sub-account of the escrow account, established pursuant to paragraph 3 of resolution 712 (1991).

يلزم قرارا مجلس اﻷمــن ٩٨٦ )١٩٩٥( المــؤرخ ١٤ نيسان/أبريل ١٩٩٥ و ١٢١٠ )١٩٩٨( العـراق بأن يكفل، على أساس خطة يقدمها إلى اﻷمين العام ويوافق عليها، التوزيع المنصف لﻷدوية واللوازم الصحية، والمواد الغذائية، والمواد، واﻹمدادات اللازمة لتلبية الاحتياجات المدنية اﻷساسية )اللوازم اﻹنسانية( المصدرة إلى العراق بموجب الشروط المحددة في القرارين المذكورين.

Paragraph 20 of resolution 687 (1991) makes clear in this respect that the above-mentioned category means materials and supplies for essential civilian needs as identified in the report of the Secretary-General dated 20 March 1991 (S/22366) and in any further findings of humanitarian need by the Security Council Committee established pursuant to resolution 661 (1990).
وتوضح الفقرة ٢٠ من القرار ٦٨٧ )١٩٩١( في هذا الصدد أن فئة اﻷصناف المشار إليها أعلاه تعني المواد واﻹمدادات اللازمة لتلبية احتياجات مدنية أساسية كما تحدد في تقرير اﻷمين العام المؤرخ ٢٠ آذار/ مارس ١٩٩١ (S/22366) وفي أية استنتاجات أخرى عن وجود حاجة إنسانية تتوصل إليها لجنة مجلس اﻷمن المنشأة عملا بالقرار ٦٦١ )١٩٩٠(.
