وتذكّر الدولة الطرف بأنه إذا امتنعت دولة عن التحقيق في ما ترتكبه أطراف خاصة غير تابعة للدول من أفعال تنتهك الحقوق الأساسية، أو مقاضاة الجناة أو تعويض الضحايا، فإنها بذلك تساعد فعلياً مرتكبي هذه الانتهاكات التي يمكن بالتالي تحميل تلك الدولة المسؤولية عنها بموجب القانون الدولي.

4.2 The State party recalls that on 30 September 1998, a Libyan citizen, Mohammed Bashir Ben Ghazi, lodged a complaint with the Department of Public Prosecutions affirming that his son, then 14 months old, had been infected with the AIDS virus after a stay at Al-Fatah paediatric hospital in Benghazi.

The State party recalls that the Committee cannot substitute its views for decisions issued by the domestic courts after evaluating the facts and the evidence of a given case unless it is proven that the conduct of the courts was manifestly arbitrary or amounted to a denial of justice.
وتذكّر الدولة الطرف بأنه ليس من اختصاص اللجنة أن تستبدل آراءها بقرارات المحاكم الداخلية بعد تقييم الوقائع والأدلة في قضية ما، ما لم يوجد دليل على أن تصرّف المحاكم كان بائن التعسّف أو أنه شكّل حرماناً من العدالة.

The Committee recommends that the State party take steps to ensure that irregular migrants, asylum seekers and refugees have access to all necessary health-care services, and reminds the State party that health facilities, goods and services should be accessible to everyone without discrimination, in line with article 12 of the Covenant.

4.15 The State party recalls that the author was initially charged on 30 January 1994 with illegal import or export of narcotics and conspiracy to import or export narcotics (Public Health Code, art. L 627).
4-15 وتذكّر الدولة الطرف بأنه قد وُجه الاتهام إلى صاحب البلاغ في أول الأمر في 30 كانون الثاني/يناير 1994 لأسباب تتعلق باستيراد المخدرات أو تصديرها بصورة غير مشروعة، وكذا بالتواطؤ من أجل استيراد المخدرات أو تصديرها (المادة L627 من قانون الصحة العامة).

The Committee draws attention to its harmonized treaty-specific reporting guidelines adopted on 1 October 2010 (CRC/C/58/Rev.2) and reminds the State party that future reports should be in compliance with the guidelines and not exceed 60 pages.
وتوجه اللجنة الانتباه إلى مبادئها التوجيهية المنسقة لتقديم التقارير الخاصة بمعاهدة محددة المعتمدة في 1 تشرين الأول/أكتوبر 2010 (CRC/C/58/Rev.2)، وتذكّر الدولة الطرف بأنه لا ينبغي أن تتجاوز التقارير المقبلة 60 صفحة امتثالاً للمبادئ التوجيهية.
