Recognizing the rights of indigenous peoples to self-determination and to maintain and develop their culture and their struggle for cultural survival, the United Nations Declaration on the Rights of Indigenous Peoples assures indigenous peoples the right to maintain, control, protect and develop their intellectual property over their cultural heritage, traditional knowledge and traditional cultural expressions (art. 31, para. 1).
55- إن إعلان الأمم المتحدة بشأن حقوق الشعوب الأصلية، إذ يقر بحقوق تلك الشعوب في تقرير المصير وفي حفظ ثقافتهم وتطويرها وفي الكفاح من أجل البقاء الثقافي، فإنه يؤكد على حقها في الحفاظ والسيطرة على ملكيتها الفكرية لتراثها الثقافي ومعارفها التقليدية وتعبيراتها الثقافية التقليدية وحمايتها وتطويرها (المادة 31، الفقرة 1).

However, as stressed by the indigenous experts who took part in the International Technical Workshop on Indigenous Traditional Knowledge (September 2005, Panama), respect for the rights of indigenous peoples, in particular their human rights, is at the heart of their concerns about the preservation, the promotion and the protection of traditional knowledge and cultural expressions.
