In this respect, the independent expert wishes to draw attention to the Guiding Principles on internal displacement prepared by the Representative of the SecretaryGeneral on internally displaced persons and contained in document E/CN.4/1998/53/Add.2. The 30 Guiding Principles address the specific needs of the internally displaced and identify the rights and responsibilities relevant to their protection.

In this respect, the independent expert wishes to draw attention to the Guiding Principles on Internal Displacement prepared by the Representative of the United Nations Secretary-General on internally displaced persons contained in E/CN.4/1998/53/Add.2, which address the specific needs of the internally displaced and identify the rights and responsibilities relevant to their protection of the internally displaced.

"
62- وتود الخبيرة المستقلة أخيراً أن تبرز أن جريمة إنكار الحق في المحاكمة العادلة ترد في المادة 3 المشتركة بين اتفاقيات جنيف فضلاً عن نظام روما الأساسي الذي يعتبر " إصدار الأحكام وتنفيذ العقوبات دون إجراء محاكمة سابقة أمام محكمة مشكّلة تشكيلاً قانونياً، وتكفل جميع الضمانات القضائية اللازمة في نظر الشعوب المتمدنة " جريمة من جرائم الحرب.

59. the Independent Expert would like to stress that such practices restrict the right to freely associate and to solicit, receive and utilize Government funds or any other contributions for the purpose of promoting and protecting human rights.
