International travel documents The previous title of this article (“Security of travel documents”) was changed to “International travel documents” by consensus at the fourth session of the Ad Hoc Committee, so as not to cause confusion for States that may have internal travel or identity documents that are not intended to be regulated by this Protocol.

It should be noted that in addition to smuggling of migrants, the Smuggling of Migrants Protocol requires the criminalization of enabling illegal stays and producing, procuring, providing or possessing fraudulent travel or identity documents when done for the purpose of enabling smuggling of migrants (art. 6).
ويجدر بالإشارة أنه إضافة إلى تهريب المهاجرين، فإن بروتوكول تهريب المهاجرين يقضي بتجريم أفعال التمكين من الحصول على إقامة غير مشروعة وإعداد وثائق سفر أو هوية مزوّرة أو تدبيرها أو توفيرها أو حيازتها عند القيام بتلك الأعمال لغرض التمكين من تهريب المهاجرين (المادة 6).

35. Pursuant to article 6, paragraph 2 (b), of the Migrants Protocol, States parties are required to establish as a criminal offence participation as an accomplice in the main Protocol offences and, if it is not contrary to the basic concepts of their legal systems, in the acts of procuring, providing or possessing fraudulent travel or identity documents for the purpose of enabling the smuggling of migrants.
35- تقضي الفقرة 2 (ب) من المادة 6 من بروتوكول المهاجرين بأن تعتمد الدول الأطراف ما قد يلزم من تدابير لتجريم المساهمة كشريك في الجرائم الأساسية المحددة في البروتوكول، ولتجريم هذه المساهمة أيضا في الأفعال المتصلة بتدبير أو توفير أو حيازة وثائق سفر أو هوية مزوّرة لغرض تيسير تهريب المهاجرين ما لم يتعارض ذلك مع المفاهيم الأساسية لنظمها القانونية.

19- تقتضي الفقرة 2 (ب) من المادة 6 من بروتوكول المهاجرين أن تعتمد الدول الأطراف ما قد يلزم من تدابير لتجريم المساهمة كشريك في الجرائم الرئيسية المشمولة في البروتوكول، ولتجريم هذه المساهمة أيضا في الأفعال المتصلة بتدبير أو توفير أو حيازة وثائق سفر أو هوية مزوّرة لغرض تيسير تهريب المهاجرين ما لم يتعارض ذلك مع المفاهيم الأساسية في نظمها القانونية.
