29. Title I of Organization Act No. 4/2000, as amended by Organization Act No. 8/2000, on the rights and freedoms of foreigners in Spain is based on the principle of equality and nondiscrimination and is applicable to all the rights to which foreigners are entitled.

Organic Law 4/2000, of 11 January, which was amended by Organic Law 8/2000, of 22 December, on rights and freedoms of foreigners in Spain and their social integration, is based on the principle of equality and non-discrimination. This law lays down a statute on the rights and freedoms of foreigners in our country.
إن القانون الأساسي 4/2000 المؤرخ 11 كانون الثاني/يناير، والمعدل بالقانون الأساسي 8/2000 المؤرخ 22 كانون الأول/ديسمبر، بشأن حقوق وحريات الأجانب في إسبانيا وإدماجهم في المجتمع، قائم على المبدأ الأساسي للمساواة وعدم التمييز، ويحدد نظام حقوق وحريات الأجانب في بلدانا، دون تمييز بين الجنسين.

Organic Law 4/2000, of 11 January, on the rights and freedoms of foreigners in Spain and their social integration, adds a new Title XV bis to the Penal Code to deal with illegal trafficking in persons.
وبموجب القانون الأساسي 4/2000 المؤرخ 11 كانون الثاني/يناير، بشأن حقوق وحريات الأجانب في إسبانيا وإدماجهم في المجتمع، أدرج في قانون العقوبات فصل جديد هو الفصل الخامس عشر المكرر، ويتصل بالاتجار غير المشروع بالأشخاص الأجانب.

In addition, Organic Act No. 10/2011 amended article 31 bis of Organic Act No. 4/2000 on the rights and freedoms of foreigners in Spain and their social integration, so as to enhance measures to protect foreign women victims of gender-based violence who choose to file a complaint against the perpetrator.
ومن جانبٍ آخر، عُدلت بموجب القانون الأساسي رقم 10/2011 المادة 31 مكرراً من القانون الأساسي رقم 4/2000 لحقوق وحريات الأجانب في إسبانيا واندماجهم الاجتماعي، بهدف زيادة تدابير حماية المرأة الأجنبية ضحية العنف الجنساني التي قد تقرر الإبلاغ عمن أساء معاملتها(7).

41. Under article 23 of Organization Act No. 4/2000 on Rights and freedoms of foreigners in Spain and their Social Integration of 11 January 2000, " Any treatment deriving from the adoption of criteria prejudicial to workers because they are foreign or belong to a specific race, religion, ethnic group or nationality " is considered to be indirect discrimination.
41- أما المادة 23 من القانون التنظيمي رقم 4/2000 بشأن حقوق وحريات الأجانب في إسبانيا وإدماجهم الاجتماعي المؤرخ 11 كانون الثاني/يناير 2000 فتعتبر تمييزاً مباشراً " أية معاملة تستند إلى اعتماد معايير مجحفة للعمال لأنهم أجانب أو لانتمائهم إلى عرق أو دين أو جماعة إثنية أو قومية " .

A recent reform of Organic Law No. 4/2000 on Rights and freedoms of foreigners in Spain and their Social Integration (the Aliens Act) enables women victims of gender violence reunited with their families in Spain to receive an independent residence permit after the issuance of a protection order.
وجرى مؤخرا إدخال تعديل على القانون النظامي رقم 4/2000 بشأن حقوق وحريات الأجانب في إسبانيا واندماجهم الاجتماعي (قانون الأجانب) يمكّن النساء من ضحايا العنف المتعلق بنوع الجنس اللاتي يلتحق بأسرهن في إسبانيا من الحصول على تصريح إقامة مستقل بعد إصدار أمر بحمايتهن.

18. The Government reported that organic Law 4/2000, on the rights and freedoms of foreigners in Spain and their social integration, had provided for the establishment of the Spanish Observatory on Racism and Xenophobia (article 71), which was mandated to conduct studies on, and formulate proposals for action to combat racism and xenophobia against migrants in Spain.
18 - وأفادت الحكومة بأن القانون الأساسي 4/2000 المتعلق بحقوق وحريات الأجانب في إسبانيا وإدماجهم الاجتماعي نص على إنشاء المرصد الإسباني لمناهضة العنصرية وكراهية الأجانب (المادة 71) الذي كلف بإجراء دراسات ووضع مقترحات لاتخاذ إجراءات لمكافحة العنصرية وكراهية الأجانب ضد المهاجرين في إسبانيا.

18. The basic regulatory provision which gives effect to the constitutional mandate established in the above-mentioned article 13, paragraph 1, of the Constitution is Organization Act No. 4/2000 of 11 January 2000 on rights and freedoms of foreigners in Spain and their integration into society, as amended by Organization Act No. 8/2000 of 22 December 2000.
18- النص التنظيمي الأساسي الذي يضع موضع التنفيذ الولاية الدستورية المنشأة في الفقرة 1 من المادة 13 من الدستور آنفة الذكر هو القانون التنظيمي رقم 4/2000 المؤرخ 11 كانون الثاني/يناير 2000 بشأن حقوق وحريات الأجانب في إسبانيا وإدماجهم في المجتمع، وذلك بصيغته المعدلة بالقانون التنظيمي رقم 8/2000 المؤرخ 22 كانون الأول/ديسمبر 2000.

Organic Act No. 10/2011 amended article 59 bis of Organic Act No. 4/2000 on the rights and freedoms of foreigners in Spain and their social integration, so as to enhance protection for foreign women in an irregular situation who are potential victims of trafficking and to encourage them to cooperate with the authorities in the investigation of trafficking offences.
ويجدر في هذه النقطة إضافة أن المادة 59 مكرراً من القانون الأساسي رقم 4/2000 لحقوق وحريات الأجانب في إسبانيا واندماجهم الاجتماعي قد عُدلت بموجب القانون الأساسي رقم 10/2011، بهدف تحسين مستوى حماية ضحايا الاتجار الأجانب المحتملين الذين هم في وضع غير نظامي، فضلاً عن تيسير تعاونهم مع السلطات في التحقيق في هذه الجرائم(18).

This is provided for under Spanish legislation: specifically, at the time the incident took place, by article 72.1 of the enabling regulations for Organization Act No. 7/1985 on the Rights and freedoms of foreigners in Spain, which required foreigners to carry their passports or documents with which they entered Spain and, where appropriate, their residency permits, and to show them to the authorities upon request.
وهذا ما ينص عليه القانون الإسباني: وبصفة خاصة، ووقت وقوع الحادث، تعين على الأجانب بموجب المادة 72-1 من اللوائح التنفيذية لقانون التنظيم رقم 7/1985 بشأن حقوق وحريات الأجانب في إسبانيا، أن يحملوا جوازات سفرهم أو الوثائق التي دخلوا بموجبها إلى إسبانيا، وعند الاقتضاء تراخيص إقامتهم، وإبرازها للسلطات عند الطلب.

The law on the rights and freedoms of foreigners in Spain and their social integration (L.O 4/00 of 11 January, amended by L.O. 8/00 of 22 December) provides that foreigners shall be refused entry into Spain when there are legally established grounds for doing so or when such action is allowed under international agreements (art. 26).
وينص القانون المنظم لحقوق وحريات الأجانب في اسبانيا وشروط اندماجهم في المجتمع (القانون الأساسي 4/00 المؤرخ 11 كانون الثاني/يناير المعدل بالقانون الأساسي 8/00 المؤرخ 22 كانون الأول/ديسمبر) على حظر دخول الأجانب إلى اسبانيا للأسباب المحددة بمقتضى القوانين المحلية أو عملا بأحكام الاتفاقيات الدولية (المادة 26).

2. In addition, under the domestic legal system, ample protection for the rights of migrants is provided in the Spanish Constitution, in Organization Act No. 4/2000 of 11 January, on the rights and freedoms of aliens in Spain and their social integration, and in its implementing regulations, especially since the most recent amendment (Organization Act No. 2/2009 of 11 December).
