The events witnessed in the State of Bahrain and other States in the region and throughout the world demonstrate the extent of the danger of terrorism and how far the terrorist elements can go in manipulating laws and international human-rights principles to serve their own subversive and terrorist ends.

As the United Nations helps to strengthen the capacity of Somalia and other States in the region to prosecute individuals suspected of piracy and to sanction those convicted, in accordance with international standards, it is imperative that more nations criminalize piracy on the basis of international law, as reflected in the United Nations Convention on the Law of the Sea.

35. The United Nations, Member States and regional organizations continue to support Somalia and other States in the region in their efforts to prosecute suspected pirates and punish convicted pirates, including onshore facilitators and financiers, consistent with applicable international human rights law.

The report examined the issue of the establishment of specialized anti-piracy courts in Somalia and other States in the region with substantial international participation and/or support, as well as building the judicial and prison capacity in Somalia and other States in the region, and contained detailed implementation proposals in this regard.
وتناول التقرير مسألة إنشاء محاكم متخصصة في الصومال ودول أخرى في المنطقة لنظر قضايا القرصنة بمشاركة دولية و/أو دعم دولي على نطاق كبير، فضلا عن بناء قدرة قضائية وقدرة في مجال السجون في الصومال وفي دول أخرى في المنطقة، كما تضمن تفصيلات بشأن مقترحات التنفيذ في هذا الخصوص.

2. The prosecution of suspected pirates and imprisonment of those convicted are being addressed by the Somali authorities and other States in the region with the assistance of UNDP, UNODC and the United Nations Political Office for Somalia (UNPOS) in the context of their work to develop the capacity of national courts.
2 - وتتولى السلطات الصومالية ودول أخرى في المنطقة حاليا مقاضاة القراصنة المشتبه فيهم، وسجن المدانين منهم، وذلك بمساعدة برنامج الأمم المتحدة الإنمائي ومكتب الأمم المتحدة المعني بالمخدرات والجريمة ومكتب الأمم المتحدة السياسي للصومال، في سياق عمل تلك المكاتب على تطوير قدرة المحاكم الوطنية.

The Council also decided to continue its consideration, as a matter of urgency and without prejudice to any further steps to ensure that pirates are held accountable, of the establishment of specialized anti-piracy courts in Somalia and other States in the region with substantial international participation and/or support.
وقرر المجلس أيضاً مواصلة نظره، على سبيل الاستعجال ودون الإخلال بإمكانية اتخاذ المزيد من الخطوات لكفالة محاسبة القراصنة، في إنشاء محاكم متخصصة لمكافحة القرصنة في الصومال ودول أخرى في المنطقة بمشاركة قوية/أو دعم قوي من المجتمع الدولي.

Also on 22 February, the Under-Secretary-General for Legal Affairs, the Legal Counsel, Patricia O'Brien, presented to the Council the report of the Secretary-General on specialized anti-piracy courts in Somalia and other States in the region (S/2012/50).

41. With respect to the prosecution of individuals suspected of acts of piracy off the coast of Somalia, in January 2012 I issued a report on specialized anti-piracy courts in Somalia and other States in the region (S/2012/50).
41 - وفيما يتعلق بمحاكمة الأفراد المشتبه في ارتكابهم أعمال القرصنة قبالة سواحل الصومال، أصدرتُ في كانون الثاني/يناير 2012 تقريرا عن المحاكم المتخصصة لمكافحة القرصنة في الصومال ودول أخرى في المنطقة (S/2012/50).

In this regard the Council appreciates the assistance being provided by the United Nations Office on Drugs and Crime and other international organizations and donors, in coordination with the CGPCS, to enhance the capacity of the judicial and the corrections systems in Somalia, Kenya, the Seychelles and other States in the region to prosecute suspected, and imprison convicted, pirates consistent with applicable international human rights law.

41. My report on specialized anti-piracy courts in Somalia and other States in the region (S/2012/50), submitted pursuant to Security Council resolution 2015 (2011) of 24 October 2011, presented an assessment of the type of international assistance that would be required for specialized anti-piracy courts to conduct cases in accordance with international standards and for States to detain suspects and imprison convicted pirates.
41 - وقد عرض تقريري عن المحاكم المتخصصة لمكافحة القرصنة في الصومال ودول أخرى في المنطقة (S/2012/50)، المقدم عملا بقرار مجلس الأمن 2015 (2011) المؤرخ 24 تشرين الأول/أكتوبر 2011، تقييما لنوع المساعدة الدولية التي ستكون لازمة للمحاكم المتخصصة لمكافحة القرصنة في الصومال لكي تتخذ إجراءات المقاضاة وفقا للمعايير الدولية، ولكي يتسنى للدول احتجاز المشتبه في أنهم قراصنة وسجن المدانين منهم.
