أولا، فالقانون اﻹنساني هدفه محدود بدرجة أكبر من قانون حقوق اﻹنسان ﻷنه ينطبق فقط على حالات الصراع المسلح، ويرمي، دون الادعاء بتحسين المجتمعات، قبل كل شيء إلى حماية حياة الفرد وسلامته الجسدية وكرامته ضد العنف والاستبداد؛ وينظم العمليات العسكرية ويضع الشروط اﻷساسية للعمل اﻹنساني لصالح الضحايا.

4.7 The State party asserts that since the author's internment in the prison system he has been constantly provided with all the necessary measures to protect his life and physical integrity and has received appropriate medical assistance; there had been no violation of his rights.
