وينص القانون الجنائي الجزائري على فرض عقوبة بالحبس والغرامة المالية على التشهير بمن ينتمون لجماعات عرقية وفلسفية ودينية معترف بها وإهانتهم، عندما يُقصد بهذه الأفعال التحريض على الكراهية ضد المواطنين أو المقيمين.

In its general comment No. 22, the Human Rights Committee clarifies that the concept of morals " derives from many social, philosophical and religious traditions; consequently, limitations on the freedom to manifest a religion or belief for the purpose of protecting morals must be based on principles not deriving exclusively from a single tradition " .
وتوضح اللجنة المعنية بحقوق الإنسان في تعليقها العام رقم 22 أن مفهوم الأخلاق مستمد من تقاليد مجتمعية وفلسفية ودينية كثيرة؛ وبالتالي فإن فرض القيود على حرية إظهار الدين أو المعتقد بغرض حماية الأخلاق يجب أن تستند إلى مبادئ غير مستخلصة حصرياً من تقليد وحيد.

The Human Rights Committee, in general comment No. 22, stressed that the concept of morals derives from many social, philosophical and religious traditions; consequently, limitations for the purpose of protecting morals must be based on principles not deriving exclusively from a single tradition(CCPR/C/21/Rev.1/Add.4, para. 8).
وشددت اللجنة المعنية بحقوق الإنسان، في تعليقها العام رقم 22، على أن مفهوم الأخلاق مستمد من تقاليد اجتماعية وفلسفية ودينية عديدة؛ وبالتالي، فإن القيود المفروضة بغرض حماية الأخلاق يجب أن تقوم على المبادئ غير المستمدة حصرا من تقليد واحد (CCPR/C/21/Rev.1/Add.4، الفقرة 8).

10.5 In this respect, the Committee recalls, as stated in its General Comment No. 34, that " `the concept of morals derives from many social, philosophical and religious traditions; consequently, limitations ... for the purpose of protecting morals must be based on principles not deriving exclusively from a single tradition'.
10-5 وتذكر اللجنة في هذا الصدد، بما جاء في تعليقها العام رقم 34 الذي نص على ما يلي: " إن مفهوم الأخلاق مستمد من تقاليد اجتماعية وفلسفية ودينية عديدة؛ وعليه، يجب أن تستند القيود المفروضة ... بغرض حماية الأخلاق إلى مبادئ غير مستمدة حصراً من تقليد واحد " .

" 13. Also emphasizes that, as underlined by the Human Rights Committee, where the need to protect public morals is invoked to justify restrictions, such restrictions must respect the universality of human rights and the principle of non discrimination and must be based on principles not deriving exclusively from a single tradition, as the concept of morals derives from many social, philosophical and religious traditions;
" 13 - تشدد أيضا على أن القيود التي تُفرض بحجة ضرورة حماية الأخلاق العامة يجب أن تَحترم، على نحو ما أكدته اللجنة المعنية بحقوق الإنسان، الطابعَ العالمي لحقوق الإنسان ومبدأ عدم التمييز، ويجب أن تستند إلى مبادئ غير مستخلَصَة حصريا من تقليد وحيد بالنظر إلى أن مفهوم الأخلاق مستمد من تقاليد اجتماعية وفلسفية ودينية كثيرة؛

32. The Committee observed in general comment No. 22, that " the concept of morals derives from many social, philosophical and religious traditions; consequently, limitations... for the purpose of protecting morals must be based on principles not deriving exclusively from a single tradition " .
32- ولاحظت اللجنة في التعليق العام رقم 22 أن " مفهوم الأخلاق مستمد من تقاليد اجتماعية وفلسفية ودينية عديدة؛ وعليه، يجب أن تستند القيود المفروضة ... بغرض حماية الأخلاق إلى مبادئ غير مستمدة حصراً من تقليد واحد " .

32. The Committee observed in general comment No. 22 (1993), that " the concept of morals derives from many social, philosophical and religious traditions; consequently, limitations ... for the purpose of protecting morals must be based on principles not deriving exclusively from a single tradition " .
