The State party should ensure that children in conflict with the law, including those in detention, are treated in consistence with the Covenant and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.

The Committee recommends that the law reform to be undertaken in this field adequately reflect the provisions of the Convention as well as other relevant international standards, such as the Beijing Rules, the Riyadh Guidelines and the United National Rules for the Protection of Juveniles Deprived of their Liberty.

Such practices contravene provisions of the Convention on the Rights of the Child, the Convention against Torture and Other Forms of Degrading Treatment or Punishment, the Fourth Geneva Convention, the United Nations Rules for the Protection of Juveniles Deprived of Their Liberty, and the Standard Minimum Rules for the Administration of Juvenile Justice.

301. With regard to the juvenile justice system in the State party, the Committee is concerned about its full compatibility with articles 37, 40 and 39 of the Convention and with other relevant standards such as the Beijing Rules, the Riyadh Guidelines and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty.

The prisons bill currently being drafted is largely inspired by United Nations norms, such as the Body of Principles for the Protection of All Persons under Any Form of Detention or Imprisonment and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty, in addition to the European Prison Rules established by the Council of Europe.

(a) Persons under the age of 18 years who are deprived of their liberty by decision of a judicial or administrative authority as a result of being alleged as, accused of or recognized as having infringed the law, and whose situation is covered by the United Nations Standard Minimum Rules for the Administration of Juvenile Justice and the United Nations Rules for the Protection of Juveniles Deprived of Their Liberty;
(أ) الأشخاص دون سن 18 سنة المحرومون من حريتهم بقرار صادر عن جهة قضائية أو إدارية نتيجة ادعاء أو اتهام أو إدانة تتعلق بمخالفتهم القانون، والأشخاص الذين تخضع حالتهم لقواعد الأمم المتحدة الدنيا النموذجية لإدارة شؤون قضاء الأحداث() وقواعد الأمم المتحدة بشأن حماية الأحداث المجردين من حريتهم()؛

It recommended that Slovakia implement the United Nations Standard Minimum Rules for the Administration of Juvenile Justice (Beijing Rules) adopted in 1985 and the United Nations Rules for the Protection of Juveniles Deprived of their Liberty (Havana Rules) adopted in 1990 and ensure that juveniles were held in detention only as a last resort.
