9. The Constitution stipulates that ratified and published international treaties and generally accepted rules of international law are a constituent part of the internal legal order; they have supremacy over domestic legislation and are directly applied when they regulate relations in a different way than domestic legislation.
9- وينص الدستور على أن المعاهدات الدولية التي صدَّق عليها الجبل الأسود ونشرها وقواعد القانون الدولي المقبولة عموماً تشكل جزءاً أساسياً من النظام القانوني الداخلي؛ إذ تحظى بالأسبقية على التشريعات الداخلية وتطبق مباشرة متى اختلفت عن التشريعات الداخلية في كيفية تنظيم العلاقات.

Article 9 of the Constitution of Montenegro states that ratified and published international agreements and generally accepted rules of international law constitute an integral part of the domestic legal order, have supremacy over the national legislation and are directly applicable when they regulate differently from the national legislation.

2. The search for effective responses to common global challenges and threats must be carried out in strict compliance with the Charter of the United Nations and the universally accepted rules of international law by uniting the efforts of all countries and overcoming confrontational thinking, bloc politics and unipolarity using the potential of multilateral diplomacy.

8. The framework of the internal legal system has been set up under Article 9 of the Constitution on the basis of the principle that ratified and published international treaties and universally accepted rules of international law form an integral part of the internal legal system and take precedence over the national legislation and apply directly when regulating matters differently from the relevant national legislation.
8- أما إطار النظام القانوني الداخلي فقد حُدد بموجب المادة 9 من الدستور على أساس المبدأ القائل بأن المعاهدات الدولية المصدّق عليها والمنشورة وقواعد القانون الدولي المقبولة عالمياً تشكل جزءاً لا يتجزأ من النظام القانوني الداخلي وتعلو على التشريع الوطني وتنطبق بشكل مباشر إذا كان تنظيمها للأمور مغايراً لما هو عليه في التشريع الوطني ذي الصلة.

Laws and other general acts enacted in the Republic of Serbia may not be in non-compliance with ratified international treaties and generally accepted rules of the international law (art. 194, para. 4).
ولا يجوز أن تتنافى القوانين والتشريعات العامة التي تصدر في جمهورية صربيا مع المعاهدات الدولية المصدّق عليها وقواعد القانون الدولي المقبولة عموماً (الفقرة 4 من المادة 194).

13- ينصّ الدستور على أن المحاكم سلطة منفصلة ومستقلة في عملها وتضطلع بواجباتها وفقاً للدستور والقانون والتشريعات العامة الأخرى التي ينص عليها القانون، وقواعد القانون الدولي المقبولة عموماً والمعاهدات الدولية المصدق عليها (الفقرة 2 من المادة 142).
