48. With regard to diplomatic protection, his delegation welcomed the progress made on the issues of continuous nationality, transferability of claims and the exhaustion of local remedies and commended the Special Rapporteur, Mr. Dugard, for his progressive approach to that very classical chapter of international law.
48 - وفيما يتعلق بالحماية الدبلوماسية، قال إن وفد بلده يرحب بما أحرز من تقدم بشأن مسائل الجنسية المستمرة، وإمكانية تحويل المطالبات، واستنفاد سبل الإنتصاف المحلية، وهو يثني على المقرر الخاص السيد دوغارد للنهج التقدمي الذي اتخذه من ذلك الفصل التقليدي جدا من فصول القانون الدولي.

16. His delegation commended the Special Rapporteur on the topic for addressing the core principles of neutrality, impartiality and independence, and encouraged him to continue to consider the possible ways in which those principles related to and shaped the context of disaster relief.
16 - وقال إن وفده يثني على المقرر الخاص المعني بهذا الموضوع لأنه تناول المبادئ الأساسية المتمثلة في الحياد والنزاهة والاستقلال، ويشجعه على مواصلة دراسة الطرق التي يمكن أن ترتبط عبرها تلك المبادئ بسياق الإغاثة في حالات الكوارث وتؤثر عليه.

32. With regard to international liability for injurious consequences arising out of acts not prohibited by international law, his delegation commended the Special Rapporteur for his treatment of the allocation of loss in case of transboundary harm arising out of hazardous activities, in particular the principles that the innocent victim should not bear the loss or injury and that the polluter should pay.
32 - واستطرد قائلا إنه فيما يتعلق بالمسؤولية الدولية عن النتائج الضارة الناجمة عن أعمال لا يحظرها القانون الدولي، قال إن وفده يثني على المقرر الخاص لمعالجته لمسألة من يتحمل الخسارة في حالة الضرر العابر للحدود الناجم عن أنشطة خطرة، وخصوصا المبدأ القائل بأن الضحية البريئة ينبغي ألا تتحمل الخسارة أو الضرر والمبدأ القائل بأن الملوث ينبغي أن يدفع.
