18. In the light of these considerations, the Working Group considers that the detention of Private Quispe Berrocal is a serious contravention of international standards relating to an impartial trial of such gravity that it confers on his deprivation of liberty an arbitrary character.
18- وبناء عليه يعتبر الفريق العامل أن احتجاز الجندي كيسبي بيروكال ينطوي على انتهاك للمعايير الدولية المتعلقة بالحق في محاكمة عادلة ويكتسي هذا الانتهاك من الخطورة ما يسبغ على احتجازه طابعا تعسفيا.

For this reason, and taking into account the lack of a response from the Government on the repeated and detailed allegations of torture reportedly suffered by Mr. Musaev, the Working Group considers that Mr. Musaev's confession, which has informed the verdicts, cannot be admitted as valid evidence.

In the three cases, and under different circumstances, the Working Group considers that the events which occurred fell within the confines of the peaceful exercise of recognized rights, such as freedom of opinion, expression and assembly, these three persons having been arrested for having exercised these freedoms in opposition to the Government.

In the light of the allegations made, which have been partly refuted by the Government without further comment from the source, the Working Group considers that the criminal proceedings against Mr. Orlando Alberto Martínez Ramírez were instituted on the basis of evidence that implicated him in a serious crime and that has been challenged by the defence from the start.
30- وفي ضوء الاتهامات المقدمة، التي فندتها الحكومة جزئياً، ومع عدم ورود ملاحظات جديدة من المصدر، يعتبر الفريق العامل أن الإجراءات الجنائية المتخذة ضد السيد أورلاندو ألبرتو مارتينيز راميريز كانت قائمة على أساس بينة تشير إلى اتهامه بجريمة خطيرة، وأن محامي المتهم اعترض على هذا الاتهام من البداية.

10. the Working Group considers that keeping in administrative detention a person who has fully served his sentence, and whose release has been ordered by the body in charge of controlling the legality of administrative detention in the framework of a deportation process, confers an arbitrary character on the deprivation of liberty.
