)أ( تكون للدولة الني ينقل إليها الشخص السلطة والالتزام باﻹبقاء على الشخص المنقول محتجزا ما لم تصرح بغير ذلك الدولة التي نقل الشخص منها؛

(a) The State to which the person is transferred shall have the authority and obligation to keep the person transferred in custody, unless otherwise requested or authorized by the State from which the person was transferred;
)أ( يكون للدولة التي ينقل إليها الشخص سلطة إبقائه قيد التحفظ، وعليها التزام بذلك، ما لم تطلب الدولة التي نقل منها غير ذلك أو تأذن به؛

(b) The State to which the person is transferred shall return the person to the custody of the State from which the person was transferred as soon as circumstances permit or as otherwise agreed by the competent authorities of both States;
)ب( تقوم الدولة التي ينقل إليها الشخص بإعادته إلى احتجاز الدولة التي نقل منها حالما تسمح الظروف بذلك ما لم تتفق على غير ذلك السلطات المختصة في كلتا الدولتين؛

)ب( على الدولة التي ينقل إليها الشخص أن تنفذ، دون إبطاء، التزامها بإعادته إلى عهدة الدولة التي نقل منها وفقا للمتفق عليه من قبل، أو لما يتفق عليه خلاف ذلك، بين السلطات المختصة في كلتا الدولتين؛

(b) The State to which the person is transferred shall without delay implement its obligation to return the person to the custody of the State from which the person was transferred as agreed beforehand, or as otherwise agreed, by the competent authorities of both States;
