" 1. The case of Mr. Moncef Marzouki

First of all, it should be pointed out that Mr. M. Marzouki was released on 13 July 1994 following a decision by the examining magistrate of the Tunis court of first instance.
بادئ ذي بدء، ينبغي اﻹشارة إلى أنه قد تم اﻹفراج عن السيد المرزوقي في ٣١ تموز/يوليه ٤٩٩١ بناء على قرار اتخذه قاضي التحقيق في المحكمة الابتدائية بمدينة تونس.

Subsequently, after his lawyer had lodged a request for his temporary release, supported by a disclaimer sent to the newspaper in question on behalf of his client and a copy of the newspaper constituting proof that the disclaimer had been published, the examining magistrate decided on the basis of this new evidence to release Mr. Moncef Marzouki.
وبناء على ذلك، وبعد أن قدم محاميه طلباً باﻹفراج مؤقتاً عن موكله، مدعوماً في ذلك، بإنكار بعث به إلى الجريدة المعنية نيابة عن موكله وبنسخة من الجريدة كدليل على أن هذا اﻹنكار قد نُشر، قرر قاضي التحقيق اﻹفراج عن السيد المنصف المرزوقي على اساس هذا الدليل الجديد.

In this regard, the Tunisian Government wishes to make it clear that Mr. M. Marzouki's arrest was not connected with his candidature in any way, and that the accusations laid against him cannot be regarded as an obstacle to freedom of opinion and expression, still less to his earlier activities or political opinions.
وترغب الحكومة التونسية، بهذا الصدد، في أن توضح أن إلقاء القبض على السيد المرزوقي لم يكن متصلاً بترشيحه المذكور، بشكل من اﻷشكال، وأن التهم الموجهة ضده لا يمكن اعتبارها عقبة أمام حرية الرأي والتعبير، ناهيك عن أن تعتبر ذات صلة بأنشطته السابقة أو بآرائه السياسية.

26. On 16 August 2000 the Special Rapporteur, together with the Special Rapporteur on freedom of opinion and expression, sent a letter to the Government of Tunisia with regard to the alleged dismissal of Dr. Moncef Marzouki from his post as professor of medicine, apparently because of his human rights work.
26- وفي 16 آب/أغسطس 2000، وجهت المقررة الخاصة بالاشتراك مع المقرر الخاص المعني بحرية الرأي والتعبير، رسالة إلى حكومة تونس بشأن ادعاءات أفادت بأن الدكتور منصف مرزوقي أقيل من منصبه كأستاذ في كلية الطب بسبب نشاطه في ميدان حقوق الإنسان على ما يبدو.

According to the information received, Dr. Marzouki had been called before a judge on 23 October 2000 and charged with belonging to a non-recognized organization, with defamation, and with propagating false news, allegedly in connection with a written contribution which he made to the Congress of Arab Human Rights Defenders in early October 2000.
