١٧ - اقترحت الصين أن ينقح العنصر ٥ بحيث يصبح فهمه كما يلي: " تعترف الدولة الطرف في الاتفاقية التي تصبح طرفا في هذا البروتوكول باختصاص اللجنة في تلقي الرسائل من اﻷفراد الخاضعين لولايتها الذين يزعمون أن دولة طرفا قد انتهكت أيا من حقوقهم المنصوص عليها في الاتفاقية وفي النظر في هذه الرسائل.
