This point was considered by some delegations to be an important consideration in the selection of a procurement method.

The Guidelines also, with the reference to the discussions in the UNCITRAL Working Group, adopted the approach of treating ERAs as a procurement method in itself, rather than an optional phase in other procurement methods.
كما اعتمدت المبادئ التوجيهية، بالإشارة إلى المناقشات التي جرت إطار فريق الأونسيترال العامل، نهج معاملة المناقصات الإلكترونية باعتبارها أسلوب اشتراء قائما بذاته، وليس مرحلة اختيارية في أساليب اشتراء أخرى.

It was stressed that this principle would be used as a ground to challenge the selection of a procurement method.

2. A procuring entity may use an electronic reverse auction as a phase preceding the award of the procurement contract in a procurement method, as appropriate under the provisions of this Law.

Furthermore, and recalling that the Working Group had provisionally agreed that the choice of a procurement method should be subject to review, it was observed that entities that had been inappropriately excluded by the procuring entity from procurement proceedings should be able to challenge the exclusion.

It was observed that there were two systems of ERAs in current use: those that treated ERAs as a procurement method itself, and those that treated ERAs as an optional phase in other procurement methods.

The ERA-specific issues addressed in the Guidelines are being considered by the Working Group, including conditions for the use of ERAs and award criteria, which would in turn identify types of procurement (goods, works and types of services) suitable for ERAs and determine whether ERAs will be treated as a procurement method in itself or an optional phase in other procurement methods.

The complexities involved in selection of a procurement method under the revised Model Law were noted.

The alternative proposal, which gained support, was to redraft the paragraph to ensure that any decision by the procuring entity to use a procurement method other than tendering and any decision not to use open solicitation in other procurement methods would have to be reflected and justified in the record.

Ms. Nicholas (Secretariat), referring to article 26, said that the implementation of an open framework agreement was in fact a procurement method.
