٣٧ - واختتم حديثه قائلا إن وفده يدين بشدة الممارسة البشعة المتمثلة في اغتصاب النساء واﻷطفال وإساءة معاملتهن في البوسنة والهرسك باعتبار ذلك أداة للتطهير العرقي.

١ - تدين بقوة استمرار الممارسة البشعة المتمثلة في اغتصاب النساء واﻷطفال وامتهانهم في مناطق النزاع المسلح في يوغوسلافيا السابقة، مما يشكل جريمة من جرائم الحرب؛

1. At its forty-ninth session, the General Assembly adopted resolution 49/205 dated 23 December 1994 entitled " Rape and abuse of women in the areas of armed conflict in the former Yugoslavia " , in which it strongly condemned the continuing abhorrent practice of rape and abuse of women and children in the former Yugoslavia.
١ - اعتمدت الجمعية العامة، في دورتها التاسعة واﻷربعين، القرار ٩٤/٢٠٥ المؤرخ ٢٣ كانون اﻷول/ ديسمبر ١٩٩٤ المعنون " اغتصاب النساء وامتهانهن في مناطق النزاع المسلح في يوغوسلافيا السابقة " ، أدانت فيه بقوة استمرار الممارسة البشعة المتمثلة في اغتصاب النساء واﻷطفال وامتهانهم في يوغوسلافيا السابقة.

2. In that resolution, the General Assembly strongly condemned the abhorrent practice of rape and abuse of women and children in the area of armed conflict in the former Yugoslavia and reaffirmed that rape in the conduct of armed conflict constituted a war crime and that under certain circumstances it constituted a crime against humanity and an act of genocide as defined in the Convention on the Prevention and Punishment of the Crime of Genocide.
٢ - وفي ذلك القرار، أدانت الجمعية العامة الممارسة البشعة المتمثلة في اغتصاب النساء واﻷطفال وامتهانهم في مناطق النزاع المسلح في يوغوسلافيا السابقة وأكدت من جديد أن ارتكاب الاغتصاب في أثناء المنازعات المسلحة يمثل جريمة من جرائم الحرب ويُعد في بعض الظروف جريمة ضد اﻹنسانية وعملا من أعمال اﻹبادة الجماعية بالمعنى الوارد في اتفاقية منع جريمة اﻹبادة الجماعية والمعاقبة عليها.

At the same session, the General Assembly strongly condemned the abhorrent practice of rape and abuse of women and children in the areas of armed conflict in the former Yugoslavia, which constituted a war crime; requested the Secretary-General to submit a report on the implementation of the resolution to the Assembly, and decided to continue the consideration of the question at its fiftieth session (resolution 49/205).
وفي الدورة ذاتها، أدانت الجمعية العامة بقوة الممارسة البشعة المتمثلة في اغتصاب النساء واﻷطفال وامتهانهم في مناطق النزاع المسلح في يوغوسلافيا السابقة، مما يشكل جريمة من جرائم الحرب؛ وطلبت الى اﻷمين العام أن يقدم الى الجمعية تقريرا عن تنفيذ هذا القرار؛ وقررت مواصلة النظر في هذه المسألة في دورتها الخمسين )القرار ٩٤/٥٠٢(.
