" 1. For the purposes of this Act, `crimes against humanity'means any of the following acts when knowingly committed as part of a widespread or systematic attack directed against any civilian population:

27 - تشمل الجريمة ضد الإنسانية أعمال القتل، والإبادة والاضطهاد وغيرها من الأفعال غير الإنسانية التي ترتكب في إطار هجوم واسع النطاق أو منهجي موجه ضد أي مجموعة من السكان المدنيين وعن علم بالهجوم.

[The following acts when committed as part of a widespread and systematic attack against any civilian population shall be punishable:]

The Special Rapporteur recalls that enforced sterilization as well as forced pregnancy constitute crimes against humanity when committed as part of a widespread or systematic attack directed against any civilian population.

In more recent codifications of crimes against humanity, rather than relying on the residual provision of “other inhumane acts”, rape has been explicitly listed as a crime against humanity when committed in the course of either an internal or international armed conflict and directed against any civilian population.

28. A crime against humanity has been committed when one of the acts listed in article 7 of the Rome Statute is committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack.

The initial definition of crimes against humanity, developed in relation to the war crimes trials after the Second World War, is " murder, extermination, enslavement, deportation and other inhumane acts done against any civilian population " .
فالتعريف الأولي للجرائم المرتبكة ضد الإنسانية، الذي وضع فيما يتعلق بمحاكمات جرائم الحرب بعد الحرب العالمية الثانية، يشمل " القتل العمد والإبادة والاسترقاق وإبعاد السكان والأفعال اللاإنسانية الأخرى التي ترتكب ضد أي مجموعة من السكان المدنيين " ().

3. Crimes against humanity require that certain capital crimes (such as murder, extermination, imprisonment, torture, rape or persecution on political, racial and religious grounds) are committed as part of a widespread and systematic attack against any civilian population on national, political, ethnical, racial or religious grounds.
٣ - الجرائم المرتكبة في حق اﻹنسانية تقتضي أن يكون ارتكاب جرائم معينة تستحق أقصى العقوبات )مثل القتل واﻹبادة والسجن والتعذيب والاغتصاب والاضطهاد ﻷسباب سياسية أو عرقية أو دينية( جزءا من هجوم واسع ومنتظم ضد أي من السكان المدنيين ﻷسباب قومية أو سياسية أو إثنية أو عرقية أو دينية.

Article 7 of the Statute recognizes " [R]ape, sexual slavery, enforced prostitution, forced pregnancy, enforced sterilization, or any other form of sexual violence of comparable gravity " as crimes against humanity if committed as part of a widespread or systematic attack directed against any civilian population.

Thus enforced disappearance may amount to a crime against humanity where the criteria listed in article 7 (1) of the Statute are met, namely where it is committed as part of a widespread or systematic attack directed against any civilian population, with knowledge of the attack.
