4. Measures against lawyers and judges

The Decree establishes inter alia a new Independent Legal Service Commission to hear complaints made against lawyers.
وينص المرسوم على أمور منها إنشاء لجنة جديدة مستقلة لتقديم الخدمات القانونية، مسؤولة عن الاستماع للشكاوى المقدمة ضد المحامين.

55. According to Principle 28 of the Basic Principles, disciplinary proceedings against lawyers shall be brought before an impartial disciplinary committee established by the legal profession, before an independent statutory authority, or before a court.

The Special Rapporteur on the situation of human rights defenders has expressed concern at the overly broad interpretation of security-related charges used against lawyers and human rights defenders, which has resulted in disproportionate and undue restrictions on their right to carry out their legitimate and peaceful activities in the defence and promotion of human rights.
وقد أعرب المقرر الخاص المعني بوضع المدافعين عن حقوق الإنسان عن قلقه إزاء الإفراط في توسيع نطاق تفسير التهم ذات الصلة بالأمن التي تستخدم ضد المحامين والمدافعين عن حقوق الإنسان، الأمر الذي أسفر عن فرض قيود غير متناسبة وغير ضرورية على حقهم في القيام بأنشطتهم المشروعة والسلمية في مجال الدفاع عن حقوق الإنسان وتعزيزها().

(b) The State party's failure to prevent and punish physical attacks against lawyers, perpetrated both inside and outside the courts, as seen in the violent attacks on Tatyana Tomina as reported by the Special Rapporteur on the situation of human rights defenders (A/HRC/19/55/Add.2, para. 211).
(ب) عدم منع الدولة الطرف الاعتداءات الجسدية على المحامين وعدم المعاقبة عليها سواء داخل المحاكم أم خارجها، مثلما شُوهد في الهجمات العنيفة التي تعرضت لها تاتيانا طومينا حسب ما ورد في تقرير المقررة الخاصة المعنية بحالة المدافعين عن حقوق الإنسان (A/HRC/19/55/Add.2، الفقرة 211).

7. The government released all political prisoners, restored civil liberties, lifted curbs against the media and dropped legal proceedings against lawyers and human rights defenders.
7- وأطلقت الحكومة سراح جميع السجناء السياسيين وأعادت الحريات الأساسية ورفعت الرقابة عن وسائط الإعلام وألغت الإجراءات القانونية التي تستهدف المحامين والمدافعين عن حقوق الإنسان.

The State party should abolish any legal provisions which undermine the independence of lawyers and should investigate all attacks against lawyers and petitioners, with a view to prosecution as appropriate.
ينبغي أن تلغي الدولة الطرف أي أحكام قانونية تقوّض استقلال المحامين وأن تحقق في جميع الهجمات المنفذة ضد محامين ومحتجين، وذلك بهدف مقاضاة الفاعلين حسبما يكون مناسباً.

Indeed, when a State does not take measures to address threats against lawyers, this can be tantamount to violation of the right to defence under international law.
وفي الواقع عندما لا تأخذ الدولة تدابير لمواجهة التهديدات الموجهة إلى المحامين فإن هذا يمكن أن يكون بمثابة انتهاك للحق في الدفاع بموجب القانون الدولي.
