54. In the opinion of Iran, the responsibility of the Security Council under the Charter to determine if an act of aggression had been committed should in no way undermine the role of the court as a judicial body.

With regard to aggression, some delegations doubted that it would be appropriate for the Security Council to determine, under article 39 of the Charter, whether an act of aggression had taken place. They would rather base their approach to the definition of aggression on General Assembly resolution 3314 (XXIX).
