124. The policy in regard to the employment of children in agricultural work is set forth in the Agricultural Relations Regulatory Act No. 134 of 1958, which stipulates as follows:

43. Under the terms of article 47 of the Agricultural Relations Act No. 134 of 1958, it is prohibited to employ male and female children under 12 years of age in agricultural work.
٣٤- ومنع قانون العلاقات الزراعية رقم ٤٣١ لعام ٨٥٩١ بموجب المادة ٧٤ منه تشغيل اﻷولاد من بنين وبنات في العمل الزراعي قبل إتمام السنة الثانية عشرة من العمر.

7. The provisions of laws supporting women's employment in agriculture (articles of the Agricultural Relations Law) are insufficient.

36. It is noteworthy that the concept of the personality of the employer is expressed in absolute terms which apply equally to men and women. This is also true of the definition of " agricultural employer " contained in article 4 of the Agricultural Relations Act No. 134 of 1985, as amended.
36- ويلاحظ إن مفهوم شخصية صاحب العمل ورد بصيغة مطلقة تجعله يشمل المرأة والرجل على قدم المساواة، كذلك هو الحال بالنسبة لتعريف صاحب العمل الزراعي المنصوص عليه في المادة 4 من قانون العلاقات الزراعية رقم 134 لعام 1985 وتعديلاته.

257. Under Syrian law, male or female children under 12 years of age cannot be employed in agricultural work (art. 47 of the Agricultural Relations Act No. 134 of 1985).
٧٥٢- ومنع المشرع السوري تشغيل اﻷطفال من بنين وبنات في العمل الزراعي قبل اتمام الثانية عشرة )المادة ٧٤ من قانون العلاقات الزراعية رقم ٤٣١ لعام ٥٨٩١(.

67. Chapter II, section 6, of the Agricultural Relations Act No. 134 of 1958 regulates health services (i.e. medical care). Article 118 of the said Act stipulates as follows:
67- ونظم الباب الثاني من قانون العلاقات الزراعية رقم 134 لعام 1958 في الفصل السادس منه، الخدمات الصحية (أي الرعاية الطبية)، إذ نصت المادة 118 منه على الآتي:

116. The legislation in force, including the Labour Act, the Agricultural Relations Act, the Housing Acts, the Social Insurance Act, the National Service Act and the Social Welfare Acts, comprise provisions that protect the family and its various members.
116- وتضمنت التشريعات النافذة، بما في ذلك قانون الأحوال الشخصية وقانون العمل وقانون العلاقات الزراعية وقوانين الإسكان وقانون التأمينات الاجتماعية وقانون خدمة العمل وقوانين الرعاية الاجتماعية أحكاماً تحمي الأسرة وأفرادها على مختلف أنواعهم.

Article 5 of the Agricultural Relations Act likewise defines an agricultural worker as " any man, woman or adolescent engaged in remunerated agricultural work for an agricultural employer or a farmer ... " .

14. Agricultural Relations Law.
14- قانون العلاقات الزراعية.

121. Agricultural Relations are governed by the Agricultural Relations Regulatory Act No. 134 of 1958, as amended, article 47 of which stipulates that: " It is prohibited to employ young persons under 12 years of age in agricultural work " .
121- وفي مجال العلاقات الزراعية، هناك قانون تنظيم العلاقات الزراعية رقم 134 لعام 1958 وتعديلاته، حيث تنص المادة 47 منه على أن " يمنع تشغيل الأولاد من بنين وبنات في العمل الزراعي قبل اتمام السنة الثانية عشرة من العمر " .

(g) Law No. 34 of 21 December 2000 amending articles 47 through 50 of the Agricultural Relations Act No. 134 of 1958 in order to prohibit the employment of minors in agriculture and specify the legal responsibility in the case of non-compliance.
(ز) صدر القانون رقم 34 تاريخ 21 كانون الأول/ديسمبر 2000 القاضي بتعديل المواد 47 و48 و49 و50 من قانون العلاقات الزراعية 134 لعام 1958 وذلك لمنع تشغيل الأحداث في الأعمال الزراعية وتحديد المسؤولية الجزائية الناشئة عن مخالفة القانون الصادر.

15. A Bill has also been submitted to amend the provisions of articles 38, 47, 48, 49, 50 and 56 of the Agricultural Relations Act No. 134 of 1958, and the amendments thereto, by providing that a seasonal agricultural worker must be at least 18 years old, unless he or she is employed as a shepherd or performs light work, in which case the child must be at least between 13 and 15 years of age.
15- وقد تضمن مشروع القانون أيضاً تعديل المواد 38 و47 و48 و49 و50 و56 من قانون تنظيم العلاقات الزراعية رقم 134 لعام 1958 وتعديلاته، واشترط التعديل في العامل الزراعي السنوي أن يكون بالغاً الثامنة عشرة من العمر على الأقل ويستثنى من ذلك الرعاة وعمال الأعمال الخفيفة بشرط أن تتراوح أعمارهم بين 13 و15 سنة.

40. We should also like to mention article 12, paragraph (a), of the Agricultural Relations Act of 2004, which states: " Arab workers shall be afforded the same treatment as Syrian workers for the purposes of the application of this Act, provided that they have a work permit from the Ministry. "
40- ومن هذا المنطلق نشير إلى أن المادة 12(أ) من قانون تنظيم العلاقات الزراعية لعام 2004 تنص على أن: " يعامل العمال العرب معاملة العمال السوريين في تطبيق هذا القانون بشرط الحصول على إجازة عمل من الوزارة " .
