1- يُعتبر تصرف جهاز أو وكيل تابع لمنظمة دولية في تأدية مهامه فعلاً صادراً عن تلك المنظمة بمقتضى القانون الدولي، أيّاً كان المركز الذي يشغله ذلك الجهاز أو الوكيل في المنظمة.

تنتهك الدولة التزاما دوليا متى كان الفعل الصادر عنها غير مطابق لما يتطلبه منها هذا الالتزام.

وفقا لقاعدة راسخة من قواعد القانون الدولي، يجب أن يعتبر تصرف أي جهاز لدولة ما فعلا صادرا عن تلك الدولة.
