The Committee against Torture, acting under article 22, paragraph 7, of the Convention against Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment, therefore concludes that the return of the complainant and his children to the Democratic Republic of the Congo would not constitute a breach of article 3 of the Convention.
9- وإن لجنة مناهضة التعذيب، إذ تتصرف بموجب الفقرة 7 من المادة 22 من اتفاقية مناهضة التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية أو اللاإنسانية أو المهينة، فإنها تخلص إلى أن طرد صاحب الشكوى مع طفليه إلى جمهورية الكونغو الديمقراطية لا يشكل انتهاكاً للمادة 3 من الاتفاقية.

3.2 The author claims that he and his children are being held in servitude of the State, in violation of article 8 of the Covenant.

Furthermore, the Committee considers that the claim that the author and his children are being held in servitude of the State, in view of the factual circumstances of the case, does not fall within the scope of application of article 8 of the Covenant.

4.7 The State party adds that the credibility of the complainant and his children has also been called into question during the asylum proceedings, particularly with regard to his detention at Joseph Kabila's residence and his abduction by militiamen in Bunia.

4.15 The State party concludes that there is nothing to indicate that there are substantial grounds for fearing that the complainant and his children would face a real and personal risk of torture if returned to the Democratic Republic of the Congo.

The complainant has in fact provided the Committee with very little information about the treatment he allegedly suffered, particularly with regard to the events in Kinshasa in 1998, and it was only by referring to the decisions issued by the national authorities that the Committee was able to piece together the allegations put forward by the complainant and his children.
وفي واقع الأمر، لم يقدم صاحب الشكوى إلى اللجنة سوى معلومات مقتضبة جداً عن المعاملة التي عومل بها كضحية، ولا سيما المعاملة التي عانى منها في كينشاسا في عام 1998، ولم تتمكن اللجنة من تكوين صورة واضحة لادعاءات صاحب الشكوى وطفليه إلا بعد الرجوع إلى قرارات السلطات الوطنية.

4.5 According to the information provided by the Swiss embassy in Kinshasa in December 2008, there is currently no ethnic conflict nor are particular ethnic groups being persecuted in Kinshasa, where the complainant and his children lived prior to their departure.
4-5 ووفقاً للمعلومات التي حصلت عليها السفارة السويسرية في كينشاسا في كانون الأول/ديسمبر 2008، لا يوجد في كينشاسا حالياً، وهي المدينة التي عاش فيها صاحب الشكوى مع طفليه قبل مغادرتها، أية نزاعات على أساس الإثنية أو حالات اضطهاد لفئات إثنية معينة.

Lastly, contrary to the complainant's allegations, the State party maintains that the complainant's family is not suffering from any form of harassment or restrictions, and that his wife and his children are in possession of their passports.
