The third sentence of paragraph 1 of article 9 provides that no one shall be deprived of liberty except on such grounds and in accordance with such procedure as are established by law.

Article 9, paragraph 1, of the International Covenant on Civil and Political Rights affirms that everyone has the right to liberty and security of person, that no one should be subjected to arbitrary arrest or detention nor be deprived of his or her liberty except on such grounds and in accordance with such procedure as are established by law.

The State party concludes that the procedure followed was in compliance with Hungarian law, as required by article 9, paragraph 1, of the Covenant which states that: " No one shall be deprived of his liberty except on such grounds and in accordance with such procedure as are established by law " .

7.6 On the question of whether the author's arrest on 24 December 1999 and subsequent detention were carried out in conformity with the requirements of article 9, paragraph 1, of the Covenant, the Committee notes that deprivation of liberty is permissible only when it takes place on such grounds and in accordance with such procedure as are established by domestic law and when this is not arbitrary.
