Protection of indigenous peoples' cultural heritage shall, in addition to the requirement ofto obtain obtaining free, prior and informed consent from the indigenous people concerned in accordance with their customary laws, reflect the need for an equitable balance between the rights and interests of those whothat develop, preserve and sustain elements of cultural heritage, and the interest of the general public.
17- بالإضافة إلى اشتراط الحصول على الموافقة الحرة والمسبقة والمستنيرة من الشعوب المعنية وفق قوانينها العرفية، يجب إن تعكس حماية التراث الثقافي للشعوب الأصلية الحاجة إلى إيجاد توازن منصف بين حقوق ومصالح أولئك الذين ينشئون عناصر التراث الثقافي ويحافظون عليها، ومصالح الجمهور عموماً.
