842. The Committee recommends that the State party adopt and implement a policy that adequately takes into account the needs of refugee, asylum-seeking and migrant children from countries affected by conflict.

The World Report on Violence against Children addressed the situation of unaccompanied, refugee and migrant children and highlighted the increasing exposure of children to violence in situations of conflict, crisis and foreign occupation, including the Occupied Palestinian Territory.

The Committee recommends that the State party ensure that asylum-seeking, unaccompanied and migrant children are not administratively detained under any circumstance.

19. The Committee recommends that the State party take steps to ensure that all disadvantaged and marginalized groups and individuals, including persons with disabilities, as well as children from low-income families and migrant children, and older persons can fully enjoy their right to take part in cultural life.

Therefore, the enjoyment of rights stipulated in the Convention is not limited to children who are citizens of a State party and must therefore, if not explicitly stated otherwise in the Convention, also be available to all children - including asylum-seeking, refugee and migrant children - irrespective of their nationality, immigration status or statelessness.
وبناء عليه، لا يقتصر التمتع بالحقوق المنصوص عليها في الاتفاقية على أطفال الدولة الطرف ويجب لذلك، وما لم تنص الاتفاقية صراحة على خلاف ذلك، أن تتاح هذه الحقوق لجميع الأطفال - بمن فيهم ملتمسو اللجوء والأطفال اللاجئون والمهاجرون - بغض النظر عن جنسيتهم ووضعهم كمهاجرين أو كعديمي الجنسية.

34. The Committee notes that the State party is a country of destination of asylum-seeking and migrant children coming from war-torn countries.
34- تلاحظ اللجنة أن الدولة الطرف هي بلد يقصده ملتمسو اللجوء والمهاجرون الأطفال من بلدانٍ مزقتها الحروب.

The Committee also recommends that the State party develop systematic awareness-raising, education and training programmes on the provisions of the Optional Protocol for all relevant professional groups working with children (including asylum-seeking, refugee and migrant children who may have been recruited or used in hostilities), notably teachers, journalists, medical professionals, social workers, police officers, lawyers and judges.
وتوصي اللجنة أيضاً الدولة الطرف بأن تضع برامج منهجية للتوعية والتثقيف والتدريب بشأن أحكام البروتوكول الاختياري لصالح جميع الفئات المهنية المعنية العاملة مع الأطفال، (بمن فيهم الأطفال ملتمسو اللجوء واللاجئون والمهاجرون الذين يمكن أن يكونوا قد جُنِّدوا أو استُخدِموا في أعمال حربية)، وبخاصة المدرِّسون والصحفيون والموظفون الطبيون والأخصائيون الاجتماعيون وأفراد الشرطة والمحامون والقضاة.

The Committee also recommends that the State party systematically collect disaggregated data on refugee, asylum-seeking and migrant children within its jurisdiction who may have been involved in hostilities abroad.
20- وتوصي اللجنة الدولة الطرف أيضاً بالانتظام في جمع بيانات مصنفة بشأن الأطفال اللاجئين، وملتمسي اللجوء والمهاجرين الموجودين ضمن ولايتها القضائية الذين قد يكونون أُشركوا في أعمال قتالية بالخارج.

Furthermore, the Committee has encouraged States parties to strengthen the protection for asylum-seeking, refugee and migrant children who may have been recruited in to, or experienced, hostilities in their country of origin.
