The Nordic countries and Poland, in their responses, agreed that there was a need to address any lack of protection of persons in situations of internal violence, which fell outside the scope of common article 3 of the four Geneva Conventions and of Additional Protocol II thereto, and when effective implementation of human rights might be limited by derogations in exceptional circumstances.

During the period under review, the following nine accused persons have been arrested and transferred to the Tribunal's Detention Facility in Arusha where they are awaiting trial on charges including genocide, conspiracy to commit genocide, direct and public incitement to commit genocide, crimes against humanity and violations of article 3 common to the Geneva Conventions and of Additional Protocol II thereto:

With regard to subject matter, the Tribunal is competent to deal with the violations defined in article 2 (genocide), 3 (crimes against humanity) and 4 (violations of article 3 common to the Geneva Conventions and of Additional Protocol II). With regard to territorial jurisdiction, the Tribunal may prosecute persons responsible for crimes committed in Rwanda and Rwandan citizens responsible for crimes in neighbouring countries.

23. The second example of such subsequent practice with respect to the application and interpretation of article 3 common to the Geneva Conventions and of Additional Protocol II thereto was illustrated in the amendment proposed by Belgium to article 8 of the Rome Statute of the International Criminal Court.
