٢٤- ويساور اللجنة القلق لكون المبادئ العامة للمصالح الفضلى للطفل )المادة ٣( واحترام آراء الطفل )المادة ٢١( ليست مطبقة بصورة كاملة وغير مدمجة كما ينبغي في سياسات وبرامج الدولة الطرف.

45. Treaty bodies should require States to provide information in their periodic State reports on the situation of minority women and on policies and programmes of the State to ensure the full enjoyment by minority women of their rights.
45- وينبغي لهيئات المعاهدات أن تطلب إلى الدول تضمين تقاريرها الدورية معلومات عن حالة نساء الأقليات وعن السياسات والبرامج التي تعتمدها الدولة لضمان تمتع نساء الأقليات بكامل حقوقهن.

The Committee is concerned that the general principle of the Convention laid down in article 12 (respect for the views of the child) is not fully applied and duly integrated into the implementation of the policies and programmes of the State party.

60- تعرب اللجنة عن قلقها إزاء عدم تطبيق المبدأ العام الخاص بمصالح الطفل الفضلى (المادة 3) تطبيقاً تاماً ولعدم مراعاته على النحو الواجب لدى تنفيذ سياسات وبرامج الدولة الطرف.

164. The Committee welcomes the adoption by the Constitutional Court of the best interests of the child as a constitutional principle, but remains concerned that the general principle of the best interests of the child (art. 3) is not fully applied and duly integrated in the implementation of the policies and programmes of the State party.
164- ترحب اللجنة باعتماد المحكمة الدستورية مصالح الطفل الفضلى كمبدأ دستوري، ولكن القلق يظل يساورها من أن المبدأ العام لمصالح الطفل الفضلى (المادة 3) غير مطبق على نحو تام وغير مُدمج حسب الأصول ضمن عملية تنفيذ سياسات وبرامج الدولة الطرف.

26. 26- كما تقلق اللجنة لأن المبادئ العامة للاتفاقية كما بُسِطت في موادها 2 (عدم التمييز) و3 (المصالح الفضلى للطفل) و12 (إيلاء المراعاة لآراء الطفل) غير مطبقة تطبيقاً كاملاً أو مدمجة على النحو الواجب في تنفيذ سياسات وبرامج الدولة الطرف.

٨٣- كما تقلق اللجنة ﻷن المبادئ العامة للاتفاقية كما بُسِطت في موادها ٢ )عدم التمييز( و٣ )المصالح الفضلى للطفل( و٢١ )إيلاء المراعاة ﻵراء الطفل( غير مطبقة تطبيقاً كاملاً أو مدمجة على النحو الواجب في تنفيذ سياسات وبرامج الدولة الطرف.

37. While noting the efforts undertaken by the State party, the Committee is concerned that two general principles of the Convention, as laid down in articles 3 (best interests of the child) and 12 (respect for the view of the child), are not fully applied and duly integrated into the implementation of the policies and programmes of the State party.
37- تشعر اللجنة، مع ملاحظتها الجهود التي تبذلها الدولة الطرف، بالقلق لأن مبدأين عامين واردين في الاتفاقية في المادتين 3 (مصالح الطفل الفضلى) و12 (احترام آراء الطفل) لا يطبقان بالكامل ولم يدمجا على النحو الواجب في تنفيذ سياسات وبرامج الدولة الطرف.

185. The Committee is concerned that the general principle of the best interests of the child (art. 3) is not fully applied and duly integrated in the implementation of the policies and programmes of the State party, as well as in administrative and judicial decisions.
185- تعرب اللجنة عن قلقها لأن المبدأ العام المتعلق بمصالح الطفل الفضلى (المادة 3) لا يطبق على أتم وجه ولا يراعى على النحو الواجب عند تنفيذ سياسات وبرامج الدولة الطرف، وكذلك عند اتخاذ القرارات الإدارية والقضائية.

404- يساور اللجنة القلق لأن المبدأ العام المتمثل في مصالح الطفل الفضلى (المادة 3) غير مطبق بالكامل وغير مدمج على النحو اللازم في تنفيذ قوانين وسياسات وبرامج الدولة الطرف وكذلك في القرارات الإدارية والقضائية.

Crippling negative attitudes, institutional and structural barriers, compounded by chronic poverty; inadequate access to higher/professional/technical/vocational education and to capital and infrastructure; ineffective schemes, policies and programmes of the State; lack of possession of productive assets; and poor health outcomes and participation significantly contribute to dehumanization and degradation in the societies where they live.
إن المواقف السلبية المعيقة، والحواجز المؤسسية والهيكلية، بالإضافة إلى الفقر المزمن، وعدم الحصول على فرص كافية للتعليم العالي/الفني/التقني/المهني، وعدم القدرة على الحصول على رأس المال والهياكل الأساسية، وخطط وسياسات وبرامج الدولة الفعالة، وعدم امتلاك الأصول الإنتاجية، وما ينجم عن ذلك من سوء الصحة والمشاركة، تسهم جميعها بصورة كبيرة في تجريدهم من الإنسانية وانحدارهم في المجتمعات التي يعيشون فيها.
