The Equal Opportunities and Social Inclusion of Persons with Disabilities Act establishes standards relating to the right of persons with disabilities to equal opportunities, defines the scope of the standards and stipulates the State's obligations in terms of ensuring effective enjoyment of this right through affirmative action, promotion and guarantees (title I of the Act).

Article 21 of the Equal Opportunities and Social Inclusion of Persons with Disabilities Act enshrines the right of all persons with disabilities to rehabilitation, taking into account the role of families and caregivers in that process.

16. The conceptual definition of disability contained in the Equal Opportunities and Social Inclusion of Persons with Disabilities Act has helped to reshape the approach to prevention, rehabilitation and the use of assistive devices. The emphasis is now on ability to function and independent living rather than on treatment.
16- ومن جهة أخرى، يُعدل مفهوم الإعاقة الذي اعتمده قانون تكافؤ الفرص والإدماج الاجتماعي للأشخاص ذوي الإعاقة مفهوم الوقاية وإعادة التأهيل والمساعدات التقنية، وذلك بالتركيز على القدرة الوظيفية والعيش المستقل، وليس فقط على علاج مشكل العجز.

34. The Equal Opportunities and Social Inclusion of Persons with Disabilities Act, in line with the Convention, provides for protecting the rights of persons with disabilities who are particularly vulnerable, including children with disabilities.
34- وتحدد مقتضيات قانون تكافؤ الفرص والإدماج الاجتماعي للأشخاص ذوي الإعاقة، التي اتُخذت وفقاً لاتفاقية حقوق الطفل، آليات حماية حقوق الأشخاص ذوي الإعاقة الأشد ضعفاً، كما هو الحال بالنسبة للأطفال ذوي الإعاقة.

109. One of the key goals of the Equal Opportunities and Social Inclusion of Persons with Disabilities Act is for the target group to achieve the autonomy needed to participate in daily life and perform everyday tasks.
109- تتمثل إحدى الغايات الأساسية التي يسعى إليها قانون تكافؤ الفرص والإدماج الاجتماعي للأشخاص ذوي الإعاقة في تحقيق الاستقلالية لهؤلاء الأشخاص ليتمكنوا من المشاركة في الأنشطة الأساسية في الحياة اليومية والقيام بها.

166. In accordance with the definitions and principles set out in the Equal Opportunities and Social Inclusion of Persons with Disabilities Act, the State has a duty to recognize the right of persons with disabilities to employment and to an inclusive workplace under equal conditions and without discrimination.

208. The Law on the Prevention of Discrimination against Persons with Disabilities stipulates the general principles of the prohibition of disability-based discrimination, special cases of discrimination against persons with disabilities, the procedure of protection of persons subjected to discrimination and the measures to be undertaken to stimulate equality and Social Inclusion of Persons with disabilities.

The States Parties have come to understand CBR to be a strategy within general community development for enhancing the quality of life of persons with disabilities, including landmine survivors, and their families by improving service delivery for rehabilitation, equalisation of opportunities, poverty reduction and Social Inclusion of Persons with disabilities.

37. Article 70 of the Equal Opportunities and Social Inclusion of Persons with Disabilities Act establishes a special arrangement for providing and funding services and technical aids for children under 6 years of age. In such cases, the only requirement is the submission of a diagnosis by the attending physician and a treatment plan; there is no requirement for previous registration in the national disability register.
37- وتنص المادة 70 من قانون تكافؤ الفرص والإدماج الاجتماعي للأشخاص ذوي الإعاقة، بدورها، على معاملة خاصة فيما يتعلق بتخصيص وتمويل الخدمات والمساعدات التقنية عندما يلزم توفيرها للأطفال الذين تقل أعمارهم عن ست سنوات، ويكفي لهذا الغرض تقديم تشخيص الطبيب المعالج وخطة للعلاج، دون ضرورة التسجيل المسبق في السجل الوطني للإعاقة.

104. All the legal provisions cited thus far as well as the policies, measures and action taken in Chile with regard to disabilities are in line with the principles of autonomous living, universal accessibility, universal design, intersectoral cooperation, participation and social dialogue: these are the guiding principles for the implementation and interpretation of the Equal Opportunities and Social Inclusion of Persons with Disabilities Act.

The Programme for the Protection, Rehabilitation and Social Inclusion of Persons with Disabilities and Their Families is aimed at providing prevention, rehabilitation and social inclusion services to persons with disabilities and their families, or those at risk of disability, through project subsidies, specialized rehabilitation services and professionalization of the human resources for improving care for persons with disabilities.

64. The National System for Comprehensive Development of the Family (SNDIF), through the Programme for the Protection, Rehabilitation and Social Inclusion of Persons with Disability and Their Families, promotes and guarantees accessibility through its subprogramme on care for the disabled, aimed at helping persons with disabilities to improve their living conditions through infrastructure and equipment projects.
64- ومن خلال برنامج الوقاية وإعادة التأهيل والإدماج الاجتماعي للأشخاص ذوي الإعاقة وأُسرهم، تعزز المنظومة الوطنية للتنمية المتكاملة للأسرة وتكفل إمكانية الوصول من خلال البرنامج الفرعي لرعاية الأشخاص ذوي الإعاقة، وذلك من أجل المساهمة في مساعدة السكان ذوي الإعاقة على تحسين ظروف عيشهم، عن طريق تنفيذ إجراءات متعلقة بالبنية التحتية وبالمعدات().

8. In early 2010, following the ratification of the Convention and with a view to incorporating its standards and principles, the Equal Opportunities and Social Inclusion of Persons with Disabilities Act (Act No. 20.422) was passed (Diario Oficial, 10 February 2010).
8- وفي مطلع عام 2010، وبعد التصديق على الاتفاقية، وبهدف إدراج القواعد والمعايير التي تنص عليها، صدر القانون رقم 20-422 (الجريدة الرسمية، 10 شباط/فبراير 2010) الذي " يحدد القواعد المتعلقة بتكافؤ الفرص والإدماج الاجتماعي للأشخاص ذوي الإعاقة " (قانون تكافؤ الفرص والإدماج الاجتماعي للأشخاص ذوي الإعاقة)().

Article 11 of the Equal Opportunities and Social Inclusion of Persons with Disabilities Act stipulates that under no circumstances shall persons with mental disabilities be subjected against their will to procedures or treatments that violate their dignity or rights or that are part of medical or scientific experiments.
وتنص المادة 11 من قانون تكافؤ الفرص والإدماج الاجتماعي للأشخاص ذوي الإعاقة على أنه: " (...) لا يجوز، بأي حال من الأحوال، إخضاع الأشخاص ذوي الإعاقة، رغما عنهم، لممارسات أو علاجات قد تمس كرامتهم أو حقوقهم أو تشكل جزءا من التجارب الطبية أو العلمية " .
