Some delegations reiterated the view that a number of substantive issues relating to the Convention on International Interests in Mobile Equipment and the preliminary draft protocol required further consideration, taking into full account the rights and obligations of States under the existing international space treaties.
159- كررت بعض الوفود الاعراب عن رأي مفاده أن عددا من المسائل المضمونية المتعلقة باتفاقية الضمانات الدولية على المعدات المنقولة والمشروع الأولي للبروتوكول تتطلب المزيد من النظر، مع أخذ حقوق الدول والتزاماتها بموجب المعاهدات الدولية الراهنة المتعلقة بالفضاء في كامل الاعتبار.

95. The view was expressed that it would be important to take into account the important role of customary law in reflecting the appropriate relationship of the Convention and the preliminary draft protocol to existing principles of international space law, particularly considering the fact that numerous States had yet to ratify some or all of the existing outer space treaties.
95- وأبدي رأي مفاده أنه سوف يكون من الهام أن يؤخذ في الاعتبار ما للقانون العرفي من دور هام في تجسيد العلاقة المناسبة بين الاتفاقية والمشروع الأولي للبروتوكول من جهة، ومبادئ قانون الفضاء الدولي الراهنة من جهة أخرى، خاصة وأن دولا عديدة لم تصدّق بعد على بعض معاهدات الفضاء الخارجي الراهنة أو كلها.

103. The view was expressed that issues relating to domestic regulatory practice would also require further consideration, particularly those relating to the licensing of any transfers of satellite operations and the export control implications of possible transfers contemplated under the Convention and the preliminary draft protocol.
103- وأبدي رأي مفاده أن المسائل المتعلقة بالممارسة اللائحية المحلية ستحتاج أيضا إلى مزيد من النظر، ولا سيما المسائل المتعلقة بالترخيص لأي نقل لعمليات ساتلية والآثار ذات الصلة بمراقبة الصادرات والمترتبة على عمليات النقل الممكنة المتوخاة في الاتفاقية والمشروع الأولي للبروتوكول.

Intensive discussion was given by the Subcommittee to new agenda items for its next session and it was agreed to consider the draft convention prepared by the International Institute for the Unification of Private Law on international interests in mobile equipment and the preliminary draft protocol thereto on matters specific to space property.

Some delegations expressed the view that the role of Supervisory Authority envisaged by the Convention and the preliminary draft protocol should be entrusted to an international intergovernmental organization of high repute and could appropriately be assumed by the United Nations or one of its organs.
108- وأعربت بعض الوفود عن رأي مفاده أن دور السلطة الإشرافية المتوخى في الاتفاقية والمشروع الأولي للبروتوكول ينبغي أن يناط بمنظمة دولية حكومية ذات صيت، ويمكن أن تضطلع به الأمم المتحدة أو إحدى هيئاتها.

113. Some delegations expressed the view that it might be preferable for the role of the Registrar under the Convention and the preliminary draft protocol to be carried out by a private entity.
113- وأعربت بعض الوفود عن رأي مفاده أنه قد يفضّل أن يتولى كيان من القطاع الخاص دور المسجّل بموجب الاتفاقية والمشروع الأولي للبروتوكول.

21. At the recent session of the Committee, there had been serious and in-depth discussion of the Convention on International Interests in Mobile Equipment and the preliminary draft protocol on matters specific to space assets.
21 - وأشار إلى أن الدورة الأخيرة للجنة شهدت نقاشا جادا ومتعمقا بشأن اتفاقية الضمانات الدولية على المعدات المنقولة والمشروع الأولي للبروتوكول المتعلق بالمسائل التي تخص الموجودات الفضائية.

The view was expressed that, as the Convention and the preliminary draft protocol had been developed under the auspices of Unidroit, it would be more appropriate for Unidroit to assume the functions of supervisory authority.
83- وأُبدي رأي مؤداه أن الاتفاقية والمشروع الأولي للبروتوكول قد أُعدّا تحت رعاية اليونيدروا، ومن الأنسب بالتالي أن يتولى اليونيدروا مهام السلطة المُشْرِفة.

156- وكررت بعض الوفود الاعراب عن رأي مفاده أن دور السلطة الاشرافية المتوخى في الاتفاقية والمشروع الأولي للبروتوكول ينبغي أن يناط بمنظمة حكومية دولية ذائعة الصيت وقد يكون من المناسب اناطته بالأمم المتحدة أو أحد أجهزتها.

The view was expressed that, since no item to be considered under a work plan had been envisaged for the Legal Subcommittee's forty-second session, in 2003, the Subcommittee would have ample opportunity to seek to resolve the key issues relating to the Convention and the preliminary draft protocol.
160- أبدي رأي مفاده أنه نظرا لعدم تحديد أي بند لكي ينظر فيه في اطار خطة عمل أثناء الدورة الثانية والأربعين للجنة الفرعية القانونية في عام 2003، سيتوفر للجنة الفرعية متسع من الوقت لمحاولة حل المسائل الأساسية ذات الصلة بالاتفاقية والمشروع الأولي للبروتوكول.

91. Some delegations expressed the view that the Convention and the preliminary draft protocol should neither undermine nor compromise existing principles of international space law and that, in case of a conflict, the latter principles should prevail.
91- وأبدت وفود رأيا مفاده أن الاتفاقية والمشروع الأولي للبروتوكول لا ينبغي أن يعطّلا ولا أن يضعفا مبادئ قانون الفضاء الدولي الراهنة، وأن هذه الأخيرة هي التي ينبغي أن تكون لها الغلبة في حال حصول تنازع.

101. Some delegations expressed the view that it would be desirable to have the more active participation of ITU in the examination of the implications of the Convention and the preliminary draft protocol on States' obligations and rights under the ITU Constitution, Convention and Radio Regulations.
101- وأعربت بعض الوفود عن رأي مفاده أن من المستحسن تفعيل إشراك الاتحاد الدولي للاتصالات في بحث آثار الاتفاقية والمشروع الأولي للبروتوكول في التزامات الدول وحقوقها بموجب دستور الاتحاد الدولي للاتصالات واتفاقيته ولوائحه الراديوية.

106. The view was expressed that it would be desirable for the Legal Subcommittee to engage in an examination of the issues associated with the transfer of space assets in a wider context than the current item, as those issues arose in various scenarios in addition to those envisaged under the Convention and the preliminary draft protocol.
106- وأعرب عن رأي مفاده أنه يستحسن أن تشرع اللجنة الفرعية القانونية في دراسة المسائل المتصلة بنقل الموجودات الفضائية في سياق أوسع من البند الحالي، نظرا إلى أن هذه المسائل تظهر في تصورات مختلفة إضافة إلى تلك المتوخاة بموجب الاتفاقية والمشروع الأولي للبروتوكول.

107. Some delegations expressed the view that further consideration should be given to the implications of the Convention and the preliminary draft protocol for partially publicly funded space assets and ensuring that the operation of creditors' remedies would not compromise the continuation of public services provided by particular space assets.
107- وأبدت بعض الوفود رأيا مفاده أنه ينبغي مواصلة النظر في آثار الاتفاقية والمشروع الأولي للبروتوكول إزاء الموجودات الفضائية الممولة جزئيا من أموال عمومية، وضمان أن إتاحة سبل انتصاف للدائنين لن يؤثر سلبا على استمرار الخدمات العمومية التي توفرها موجودات فضائية معينة.

111. Some delegations expressed the view that the Secretariat should be requested to conduct a preliminary examination of the possible legal, financial and other requirements for the operation of the Supervisory Authority under the Convention and the preliminary draft protocol, with a view to providing a report to the Legal Subcommittee at its forty-second session, in 2003.
111- وأعربت بعض الوفود عن رأي مفاده أنه ينبغي أن يطلب إلى الأمانة أن تجري دراسة مبدئية حول الاقتضاءات القانونية والمالية وغيرها المحتملة لتشغيل السلطة الإشرافية بموجب الاتفاقية والمشروع الأولي للبروتوكول بقصد تقديم تقرير إلى اللجنة الفرعية القانونية في دورتها الثانية والأربعين في عام 2003.

Some delegations expressed the view that it might be desirable to establish linkage between the information to be contained in the registry envisaged by the Convention and the preliminary draft protocol and the Register maintained by the Secretary-General of the United Nations under the Registration Convention, in order to allow adequate access of States to both sets of information.
