Representatives of the Secretary-General and Cambodia have negotiated and elaborated a text of a draft Agreement between the United Nations and the Royal Government of Cambodia Concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea.
تفاوض ممثلو الأمين العام وكمبوديا وأعدوا نصا لمشروع اتفاق بين الأمم المتحدة والحكومة الملكية لكمبوديا بشأن مقاضاة مقترفي الجرائم المرتكبة في عهد كمبوتشيا الديمقراطية، وذلك بموجب القانون الكمبودي.

Welcoming the efforts of the Secretary-General and the Royal Government of Cambodia to conclude the negotiation of the draft agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea contained in the annex to the present resolution,
وإذ ترحب بالجهود التي بذلها الأمين العام والحكومة الملكية لكمبوديا لاختتام التفاوض على مشروع الاتفاق بين الأمم المتحدة والحكومة الملكية لكمبوديا بشأن المقاضاة بموجب القانون الكمبودي على الجرائم المرتكبة خلال فترة نظام كمبودتشيا الديمقراطية الوارد في مرفق هذا القرار،

1. Approves the draft agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea contained in the annex to the present resolution;
1 - توافق على مشروع الاتفاق بين الأمم المتحدة والحكومة الملكية لكمبوديا بشأن المقاضاة بموجب القانون الكمبودي على الجرائم المرتكبة خلال فترة نظام كمبودتشيا الديمقراطية الوارد في مرفق هذا القرار؛

According to the Cambodian authorities, the Agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea was to be submitted for ratification by the relevant Cambodian constitutional authorities as a matter of priority.
ووفقا لما أفادت به السلطات الكمبوديــة، كان مــن الضروري تقديم الاتفاق المبرم بين الأمم المتحدة والحكومة الملكية لكمبوديا بشأن المقاضاة بموجب القانون الكمبودي على الجرائم المرتكبة خلال فترة نظام كمبوتشيا الديمقراطية إلى السلطات الدستورية الكمبودية ذات الصلة للتصديق عليه كمسألة ذات أولوية.

Article 8, paragraph 3, of the Agreement further provides that the United Nations and the Royal Government of Cambodia agree that, when an international Deputy Director of the Office of Administration has been appointed by the Secretary-General, the assignment of that person to that position by the Royal Government of Cambodia shall take place forthwith.
وتنص الفقرة 3 من المادة 8 كذلك على أن الأمم المتحدة والحكومة الملكية لكمبوديا تتفقان على أن تقوم الحكومة الملكية لكمبوديا، عند تعيين الأمين العام لنائب دولي لمدير مكتب الشؤون الإدارية، بإسناد ذلك المنصب لذلك الشخص على الفور.

4. On 28 April 2005 a notification was sent to the Government of Cambodia indicating that the legal requirements on the United Nations side for the entry into force of the Agreement between the United Nations and the Royal Government of Cambodia concerning the Prosecution under Cambodian Law of Crimes Committed during the Period of Democratic Kampuchea, done at Phnom Penh on 6 June 2003, had been complied with.
4 - في 28 نيسان/أبريل 2005، أُرسل إشعار إلى حكومة كمبوديا يفيد باستيفاء الأمم المتحدة للشروط القانونية لبدء نفاذ الاتفاق المبـرم بينهـا وبيـن الحكومة الملكية لكمبوديا المتعلق بالمحاكمـة، بموجب القانون الكمبودي، على الجرائم التي ارتـُـكبت في عهد نظام كمبوتشيا الديمقراطية الموقـَّـع في بنوم بـنـه في 6 حزيران/يونيه 2003.
