Hungary believes that in view of the recent development in the field of international environmental law, in every case when significant harm is caused by an aquifer State to another aquifer State, adequate compensation should be provided in accordance with " the polluter pays " principle.

Where significant harm nevertheless is caused to another aquifer State or a State in whose territory a discharge zone is located, the aquifer State whose activities cause such harm shall take, in consultation with the affected State, all appropriate response measures to eliminate or mitigate such harm, having due regard for the provisions of articles 4 and 5.

3 - إذا طلبت دولة من دول طبقة المياه الجوفية من دولة أخرى من دول طبقة المياه الجوفية تقديم بيانات ومعلومات غير متوافرة عادة، تبذل الدولة الثانية قصارى جهدها لتلبية الطلب، ولكن يجوز لها أن تجعل تلبيتها للطلب متوقفة على قيام الدولة الطالبة بسداد التكاليف المعقولة لجمع هذه البيانات أو المعلومات وتجهيزها، حسب الاقتضاء.
