The Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions

He reminds Governments, inter alia, of their obligations, reflected in the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions, to conduct exhaustive and impartial investigations into all suspected cases of extrajudicial, summary or arbitrary executions.

This obligation is confirmed in other international human rights instruments, including the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions and the Declaration on the Protection of All Persons from Enforced Disappearance.

In this connection, the Special Rapporteur wishes to draw the Government's attention to the standards pertaining to the investigation of extrajudicial executions contained in the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.

The Committee was guided instead by the United Nations Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, which incorporated tests of necessity and proportionality.

It will be recalled that the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions emphasize the absolute respect for life even during " a state of war or threat of war, internal political instability or any other public emergency " .

2. In the same resolution, the Commission also invited OHCHR and the Crime Prevention and Criminal Justice Division of the Secretariat to consider revising the Manual on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions.

9. Regarding the Manual on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions, OHCHR has made available existing relevant legal material to those human rights bodies requesting them in the fulfilment of their mandates.

The duty to investigate human rights abuses has been further reiterated and confirmed in a number of international instruments, including the Declaration on the Protection of All Persons from Enforced Disappearance and the Principles on the Effective Prevention of and Investigations of Extra-legal, Arbitrary and Summary Executions.E/CN.4/1999/39

77. The Commission furthermore recommends that the Government of Togo should adopt legislative and other measures to punish and prevent the perpetration of such violations, in conformity inter alia with the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions.

111. In its resolution 2005/26, the Commission requested the Secretary-General to provide appropriate resources, from within existing overall United Nations resources, to fund the activities of the Office of the High Commissioner in implementing that resolution, including a revision of the Manual on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.

The duty to prevent extrajudicial, summary or arbitrary executions is clearly set forth in the Principles on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions.
إن واجب منع وقوع حالات الإعدام خارج نطاق القضاء أو بإجراءات موجزة أو تعسفاً يرد بوضوح في مبادئ المنع والتقصي الفعالين لعمليات الإعدام خارج نطاق القانون والإعدام التعسفي والإعـدام دون محاكمـــة .

Chapter III. Model Protocol for the Legal Investigation of Extra-legal, Arbitrary and Summary Executions
الفصل الثالث - البروتوكول النموذجي لعمليات التحقيق القانونية في حالات اﻹعدام خارج القضاء واﻹعدام التعسفي أو بإجراءات موجزة

The Secretary-General did not receive any comments or suggestions concerning the possibility of revising the Manual on the Effective Prevention and Investigation of Extra-Legal, Arbitrary and Summary Executions.
٢٣- ولم يتلق اﻷمين العام أي تعليقات أو اقتراحات بشأن امكانية تنقيح " دليل منع ممارسات تنفيذ اﻹعدام خارج نطاق القانون واﻹعدام التعسفي واﻹعدام بإجراءات موجزة والتحقيق في تلك الممارسات بصورة فعالة " .

The Special Rapporteur has learnt recently that efforts are under way to amend the Manual on the Effective Prevention and Investigation of Extra-legal, Arbitrary and Summary Executions (ST/CSDHA/12) produced by the Crime Prevention and Criminal Justice Branch of the United Nations Secretariat in May 1991.
٠١٤- وقد علم المقرر الخاص مؤخرا أن ثمة جهودا تبذل لتعديل دليل منع ممارسات تنفيذ أحكام اﻹعدام خارج نطاق القانون واﻹعدام التعسفي واﻹعدام دون محاكمة والتحقيق في تلك الممارسات (ST/CSDHA/12) الصادر في أيار/مايو ١٩٩١ عن فرع منع الجريمة والعدالة الجنائية التابع لﻷمانة العامة لﻷمم المتحدة.

14. In cases of allegations of torture, illtreatment or executions, investigations should be conducted in accordance with the Principles on the Effective Prevention and Investigation of Extralegal, Arbitrary and Summary Executions and the Principles on the Effective Investigation and Documentation of Torture and Other Cruel, Inhuman or Degrading Treatment or Punishment.
14- وفي حالات الادعاءات المتعلقة بالتعذيب أو سوء المعاملة أو الإعدام، ينبغي إجراء التحقيقات وفقاً لمبادئ المنع والتقصي الفعالَيْن لعمليات الإعدام خارج نطاق القضاء أو الإعدامات التعسفية أو بإجراءات موجزة() ومبادئ التقصي والتوثيق الفعّاليْن بشأن التعذيب وغيره من ضروب المعاملة أو العقوبة القاسية

Governments, including those of countries where extra-legal, Arbitrary and Summary Executions are reasonably suspected to occur, shall cooperate fully in international investigations on the subject.
